We have a main road in Lakhanpur, Kanpur which is supposed to be 120 Ft wide. Originally, it was a very good road. However, due to water logging in depressed areas & choking of drains etc,the road has virtually disappeared. There are electric poles on this main road without dividerss. Due to shrinkage of road, there have been many accidents - some of them fatal. The cars & bikes do ply on this road, but the maintenance of vehicles is veru high. Above all, due to this condition of raod, it looks as if we are staying in a very backward area. I intend to use Right to Information to address this problem. I understand that this Road comes under purview of PWD, while Drainage system was provided by Kanpur Developement Authority and is supposed to be cleaned by Municiple Corporation & Electric Poles under KESCO ( Electricty Supply Corporation). Pl. guide me on following: 1. How can I post my complaint on Net. I have checked UP site of RTI, where there is no facility to log a complaint on web. Even if I were to do so, how do I pay the required Fee. Alternatively, I will have to send the hard copy. 2. Since there will be four different deptt are involved namely PWD, KDA, Municiple Corporation & KESCO - Can I use one complaint and make all the four deptt a party. If so in what format. 3. Who do I address the complaint to? In U.P. Site, these deptts are not listed and I am not sure if they have PIO. Pl. guide. By using RTI you can get information so either file RTI for information (make an application with the help of link/s given below) or file a complain, wait for 15/20 days and ask for action taken report under RTI. 2.Application can be filed on line but RTI fee for that traditional method/s, better file in hard copy 3. Include these lines in your RTI application: If you do not directly deal with this application or a part thereof, kindly forward it to the right PIO under section 6 (3) of Right to information Act with intimation to me. RTI procedure is : 1. RTI Application with Fee to PIO 2. If no reply/ not satisfied with reply in 30 (or 35 days in case of submission to APIO or under Section 6(3)), First Appeal to the First Appellate Authority (normally a officer higher than the PIO) 3. If no reply/ not satisfied with reply in 45 days to the First Appeal, then Second Appeal to the CIC/SIC (time period is 90 days) Your RTI application has to be as per the Uttar Pradesh Govt. RTI rules and fees.These are available in the Guide segment of the forum. Thanks for your prompt reply. Pl. clarify - since my complaint involves 4 different deptt, should I make one common application addressed to all 4 deptt. Or should it be 4 different sets of applications - one each to each deptt. Regards Ranajn Kulshreshtha |

File four separate applications to the four authorities. Each application should ask for information relevant to that public authority. |

File single application with the Head of the Distt. and the they will further send the application to different agencies . Only once you will have to pay fees. I applied this in speed breakers case and sent the application through City Magistrate ,who further sent the photo copies of my application to 5 different agencies dealing in speed breaker. and wrote me to contact them. |

Generally if it is possible to identify different departments who have your information it is better to file application to each one of them asking for information relevant to them. This helps in avoiding the time taken in transfer of application. But in this case the information seems to be related so a single application may be filed. Rajesh ji has prior experience of filing similar RTI application so his advise holds grounds. If you file a single application, the recepient PIO is required to forward the application to all concerned departments, without any extra cost to you. |

Thanks for your advice. kanpur is a very notorious place. Yesterday only, I have been informed that RTI Applicants are not welcome and they are likely to be harrased. Therefore, I propose to file RTI on behalf of Presidents of about 7 colonies falling in the area, where these roads are affecting all of us. Is it possible to file an RTI application on behalf of Housing Society or group of Housing Societies. If yes, what should be the right format. Pl. guide. Regards Ranjan Kulshreshtha |

Ranjan, I am sure that you Can get at least 25 residents of those 7 colonies to spend Rs. 10.00 each. Just send 25 similar applications, with each individuals address and signed by the the respective person. The more number of persons, the lesser the chances that anybody can be harassed. You can put them all in one envelope and send them by local speed post to the PIO. Just keep tracking it on line and keep a record of delivery. |

That's better. Joint application by multiple applicants is a controversial area and is better to avoid it especially if you want the information in time. |
