RTI Petition and Pension under Employees Pension Scheme 995
One of the Senior Citizens (aged 75 plus with little mobility) of my Locality approached me with a grievance that he has not received Pension for over 20 monhs. I drafted letter for him and sent by speed post in April 2012. After waiting for one month, I sent an RTI Petition in his name. Within 10 days of receiving the RTI Petition, an Officer from Provident Fund Office, Kolkata rang up and assured to pay him his pension and clear the dues for 20 months. As a follow up, I have drafted the following letter :
Quote :1. Please refer to my letter dated 07 April 2012 (sent by Speed Post) in which I brought out that I have not been paid monthly pension from November 2010 onwards, although Life Certificates were furnished in time. Prior to this, I have also sent a number of letters by ordinary post.
2. Only after I filed an RTI petition, one of your Officers rang up on my mobile no. giving unconvincing reasons for non-payment of Pension for over 20 months. Even, reply to my letter requesting for investigation into the issue of non payment of Pension for over 20 months has not been received, not to speak of ordering an investigation/ enquiry for non payment of pension for over 20 months.
3. From the above facts, it is very clear that had I not filed an RTI Petition, the issue of my pension would continue to be in “Dormant Stage”
4. In the given background, I would request that
- the Officer and the personnel who are responsible for holding my pension for over 20 months be identified and action initiated against them for injustice and irreparable loss caused not only to a Senior Citizen of over 75 years of age, but also depriving him the monthly pension, which contributes in a significant manner to the source of livelihood to me and my wife.
- Interest @ 12% be paid to me for holding my pension for 20 months by deducting from the salary of the defaulting personnel.
5. In the event I do not get any reply and your action plan to compensate me and take action against the erring official, I will move the matter before appropriate forum for justice.

In nutshell, only the RTI application brought him the much needed relief. Need I to say that RTI Act 2005 is a powerful weapon

I suggest that let gentleman get arrears of pension and other dues first and then he can represent with your assistance for compensation, action against officers etc.Sponsorer

Sir,
I fully agree with my other colleagues about the same.
Also please download the following direction, that may be used later on with an appropriate rti application.
p.s. the government officials have a habit of "adjusting an over payment" if you press for action against the erring officials "first".
so i fully agree that you get the pension first and then you can ask for action against the erring officials as per the rti act questions.
Also please read the other act that i have uploaded especially if it is the state of Maharashtra.
Do let us know the results by uploading the replies.
it would be a great help for others.
