Need Help: Can i ask for 3rd party IT returns

Can i ask for 3rd party IT returns of a person who has undisclosed investments in shares and debentures. He made certain disclosures in a court of law and that does not tally with his known sources of income. He serves in a GOI u/taking. Just let me know.

Income tax department has consistently taken view that the information given to them is in fiduciary capacity, and personal in nature. As such, they always deny such information . I think that in case of film financer bharat shah, an exception was made, because there was some 'benami gangster' investment.

But if you are speaking about a government employee, he has to make a sworn ststement of assets, including assets held by family members, to their department every year. I think a copy of that statement can be demanded. Then you can match the same with his known sources of income

Dear Atul,
Declaring of Property Returns is applicable only to Group B and above Govt. officials. What if the Govt servant is of a lower level and still possessing property/assets more than his known sources of income.
