Unhappy Employer has not given complete salary for last 3 months.

    Sir,

I am an employee of a company in Delhi working there for last 1 year.My employer has not given my complete salary in last 3 months, still around 20,000 is still pending with him.
Whenever i ask him for my salary he always answers in a rude manner and tells me that he will pay it when ever he will have it.
I am resigning from the company now and i need my pending salary with him.

What action can i take against him to get my pending salary amount.....???

    Plzzzz suggest.....????

You may lodge complaint with Labour Commissioner of the area where office of employer is situated. You can also contact recognised trade union to help you out. In case labour Commissioner does not take action, you can use RTI after 2-3 months of complaint by referring:

    Long pending? :

alternatively contact personally or write to PF inspector/ commissioner telling him you have been denied salary and wages and PF is also not being paid....... follow it up with RTI......

    In RTI seek following details:

    1. List of employees as per records of your organisation

    2. Copy of records showing your salary and PF deduction with PF number, last PF deducted

    3. Copy of list of employees who have left job in last 3 months, as per PF records...

    4. copy of salary details of yours as per PF office records....

    5. Day to day action taken on your representation...........

Forward copy of above to labour dept too.
