    Time period for second appeal under RTI

    Hounerable members
    if the Ist appleate authority orders the CPIO to supply the information. But the office from which information is sought gives false and incomplete information to the CPIO and the same is sent by the CPIO. and the complaint is filed before the Ist appleate authority against the CPIO. what is the wait period one should wait to file a complaint before the CIC.

    FAA has given his/her order to CPIO.
    1) as per your post you have already complaint to FAA about false and incomplete information provided by CPIO.
    2) you have 90 days to approach CIC after FAA order for false and incomplete information.

    so better file 2nd appeal to CIC as FAA has already given his order.

    Once the FAA has given his order, then there is no time period prescribed under RTI Act, as to how much one should wait, but around 15 days should be a good time.

    In case where a PIO does not provide the requested information after a First Appellate Authority's decision to provide the same, then there is no provision under the RTI Act, to re-approach a First Appellate Authority, but the only available provision is to file a second appeal before an Information Commission.

    Please note that as per RTI Act, one should file a second appeal within 90 days of the date of receipt of a FAA's decision.
