    Yes the Registrar of society is a public and falls under the RTI Act. You can ask from that department any question with is related to registration of societies.

    You can also get the copy of by-laws of the societies which were registered by them.

    No, the societies are not a Public Authority and are not covered under RTI Act.

    Devang,

    The questions you have to answer are:
    1. Whether the Society is substantially financed and/or controlled by the Government ?
    2. Whether the Society uses any Government land etc. or other resources ?
    3. Does it perform a unique and monopolistic service on behalf of the state ?

    My belive is as under which I need to confirm.

    Section 2 (h) which says "information" means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force


    Also refer to Section 8 (j) which says : information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person.


    So the Society providing Education ( a Public Service) can be under RTI.

    Please confirm.

    Can an association formed in 1901, registered under the Societies act xxi of 1860 and thereafter per Charity Commissioner demand registered under the Bombay Public Trust Act 1950 now say they are exempted from all clauses of the SRAct xxi of 1860 as the former has been superceded by the latter.
    I am trying to get the list of members per Sch VI Rule 15 as believe a lot of dead members still being shown as living.
    Per the Public Trust Act there is no real way to get the list of members. Tried 2(f) of the RTI but refused by the Jtcc stating this not a document filed with them.
    It is a catch 22 situation
