Societies are not covered under RTI as they are not public authority. They are registered under society act by Registrar of societies after they have submitted the rules and by-laws under which they will be working. In case a society not is working as per the rules and by-laws you can file a complaint to the Registrar of Societies.

You can file RTI application to the Registrar of Societies to know about the rules, by-laws and other conditions under which your society should work. You can also get a copy of by-laws which was submitted by the society at the time of registration.

Please browse through the site to get information on how to file a RTI application. Some important links are given below in my signature.

Re: Regarding the co-operative housing society.

    Hi Rizwan,

Co-operative Societies are covered under the RTI act but indirectly under sec. 2(f) of the act.

So you cannot file a RTI application to the secretary of the society, but you will have to file a RTI application to the Deputy Registrar Co-operative Societies.

This is how it will work:

    1) You will file a RTI application to the Deputy Registrar Co-op Sty's.
    2) Deputy Registrar will forward you application to the Chairman/Secretary of your society.
    3) The Chairman/Secretary of your society will provide all the requested information to the Deputy Registrar.
    4) Now the Deputy Registrar will provide you with the information thus procured from the Chairman/Secretary of the society.

I understand you are in Mumbai, then the office of Registrar of Co-operative Societies is located at 6th floor, Malhotra House, Opp. G.P.O, Mumbai 400 001.

The office is divided in a number of wards, and the ward applicable to you will depend upon the area in which your society is located, for example my society is located in Borivali and so the ward applicable to me is R Ward.

Write your RTI Application addressed to:
    The Public Information Officer,
    Deputy Registrar - (Your Ward)
    Above mentioned address.

You will need to find out which ward is applicable to your society, download an RTI application form applicable for mumbai from here http://www.rtiindia.org/forum/attach...opra-rti_2.doc, demand all the information you require under the title in the RTI form Description of the Information required, paste a Rs.10/- court fee stamp, and mail it by Speed post with acknowlegment/ alternately you can also mail it by Vichare Courier.

Keep the acknowledgment with you, as you will require it as proof of application in case you need to go in for first appeal later on.

Please browse through the various links on the home page of this forum and increase your knowledge before filing the RTI application.

Simple things like how to frame your question are also very important, for example your query should be in the form of seeking information rather than seeking opinion or explaination.

Under the title in the application form Details of Information sought Ask:

    1) Please provide me with the certified photocopies of the xxxx documents.

You can also seek inspection of complete records under the RTI act.

If you require any further assistance in drafting your RTI application please feel free to revert back and the members of our forum will be happy to help you.

    Hope this helps.
