To attend or not personal hearing by faa

Respected sir Is it necessary to attend a second request made by FAA for personal hearing regarding the information sought pertaining to third party information (third party has given a acceptance to disclose the required information to me under RTI 11(1) This request for second hearing is made on completion of 30 day from the date of filing the first appeal till now no orders has been passed by the FAA I request from my senior learned friends for guidance

Legally, you are not required to attend the hearing. But it is advisable to attend the hearing as you have nothing loose. My suggestion is that it is better to attend the hearing well prepared if it is not otherwise inconvenient to you. You are bound to benefit provided your voice is stronger than your pen..

In one of the RTI Applcation asking for simple 3-4 pages info along with a copy of noting sheet,the CPIO has asked to inspect the records in person. In my view , it is applicable only when huge records are asked for or the info sought for is not specific. also it is the right of applicant to inspect records only when desired by him but can not be forced on him with a view to harass him physically and financially.

However, attending the same is a personal choice depending on convenience and as Col. Kurup said having a voice stronger than your pen.

The PIO has no authority to ask the applicant to inspect the records as a precondition for providing the requestted information irrespective of its contents as 3-4 pages or huge. Such descretion is purely that of the applicant.
