Question Unanswered: Pls help...

Hello Mr. Kushal,

We had asked for information under RTI for 4 shops (Hotel, Pan bidishop, ISD / ISD booth & lottery centre) situated in front of our house (outside society wall compound) from BMC, M-West ward, Sr. Inspector, Shops & Establishment Dept. The officer truthfully provided the information, but we were shocked to know that the hotel owner has used our address as his residence, same with the case of Pan Bidi Shop. (diffrent owner, but address is near about same as ours)
Whereas the telephone booth & lottery centre is NOT registered under shops & establishment act

Pls guide us how we can take it forward to prove that the hotel owner has illegaly used our address for his correspondance.

(The commitee of the our society is not in working condition, so no help to be expected from our society members.)
We had also asked for documents used by above hotel for obtaining the health license under Section 394 of MMC, Act, but the health officer denied it by saying 'Old documents, cannot be found'. He had intimate us to put 2nd appeal to CIC..

Pls help !!! Should we file a case against the hotel owner ?

See as far as RTI Act is concerned you have got your information.
As per the informations given by BMC now Its a simple and clear case of IPC 420 , where in a case @ FIR should be registred by you in your local Police Station and the copy of the same should be sent to the BMC and the Hotel Owner.

These are common proactises and the Hotel Owner is largely responsible for the fraud i.e. Misuse of you Reisdence proof. So I would also advise that should proceed further with an FIR and later complaints to BMC etc.

In case you have any legal "Non Information" you can always heir a Attorney (Advocate) for the same.

So go ahead and let us Know about your successful finale...
