Question: Indian Immunologicals Limited- A wholly owned subsidiary of NDDB

Indian Immunolgicals limited is a subsidiary company ---wholly owned by National Dairy Development Board of India(which was created by an Act of Parliament of India).Pl. clarify whether Indian Immunologicals Limited as a separate company comes under the purview of RTI Act ? Can one seek company information under RTI Act from this company.

Rule 2(h) of the RTI Act 2005 defines a "public authority"-

a "public authority" means any authority or body or institution of self- government established or constituted—
(a) by or under the Constitution;
(b) by any other law made by Parliament;
(c) by any other law made by State Legislature;
(d) by notification issued or order made by the appropriate Government,
and includes any—
(i) body owned, controlled or substantially financed;
(ii) non-Government organisation substantially financed,
directly or indirectly by funds provided by the appropriate Government;

If the Indian Immunolgicals limited is wholly owned by NDDB, which comes under 2(h)(b) of the RTI Act, then IIL is, without any question, comes under the purview of the RTI Act. And Hence, one can seek company information under RTI Act from this company.
