    Question Group Housing Society information


    I wish to know certain things about Coop. Group Housing Society in Delhi:-
    1. Are cooperative group housing socities in Delhi comes under RTI?
    2. How can I get detail information from any registered CGHS?
    3. Who governs and approves the construction in a CGHS & who governs the functioning of a CGHS?

    Pls help

    1. No
    2. You can ask the office bearers of your CGHS. If that doesn't work you can file RTI application in the office of RCS. They will get the information from CGHS and provide it to you.
    3. CGHS is governed by the provisions of Cooperative Societies Act. All members have a right to vote. Office bearers are responsible for administration. Detailed provisions are available in the society's bye-laws.

    I think CGHS will take shelter under Karnatakas High court ruling stating they are not governed by RTI. Below is the small news article on this issue

    BANGALORE:The High Court has held that co-operative societies in the state do not come under the purview of the Right to Information Act.

    Justice N Kumar, allowed the petitions filed by house building co-operative societies and co-operative banks which have challenged the order of the Information Commission.

    The court held that cooperative societies are not governed or financed by the state government and they need not furnish information under the Act that has come into effect from 2005.
