| Respected Moderators and other knowledgeable people on this forum First I am Dr.Yogesh Kumar Chhetty Very recently to be precise on the 11th of January I appeared for the All India Post Graduate Medical Entrance Exam (AIPGMEE) conducted by the All India Institute of Medical Sciences. the idea of filing an RTI against AIIMS has come because a lot of the questions that were framed in the exam were containing choices that are ambiguous.the exam is a multiple choice question (MCQ) exam and it has 300 questions with each question having only 1 answer and four options.in a lot of questions the answer was not clear as more than two options were coming out to be the answers i understand and have read the judgements regarding previous cases against AIIMS. Still I have only one doubt In what way will the quality of the doctors going in for specialisation decrease if AIIMS releases the question paper and a model answer sheet with proper references of the books it has used for framing the question. Sir i ask this question because, qualifying this exam has become the centre point of students who slog it out for 6 years, right from the time they enter the MBBS course till the time they come out and AIIMS in the whims and fancies of the Professors makes fun of the labour that a candidate has put in. sir there is no fixed syllabus of the exam and no books are recommended...as may be known to you...it is HUMANLY IMPOSSIBLE for any person on Earth to claim that he knows everything about a subject and has read every book in that subject.............so how can a person preparing 23 subjects read all the books and answer the questions....sir I just want to know the books that AIIMS question setters use as a reference ......this is in the larger interests of the public, i mean doctors who are preparing as they will be studying more extensive books...... KINDLY HELP ME OUT WITH THIS AND PLEASE PROVIDE ME A REPLY AS TO WHY AN RTI CANT BE FILED AGAINST AIIMS TO GET THE QUESTION SHEET WITH THE MODEL ANSWER SCRIPT WITH REFERENCES |

thank you karira very much for the information that u have given me....still i wud like to bring to ur notice that i have already studied the links u have given me and have seen that on both occasions that AIIMS was asked for the question papers and answer scripts (Model) AIIMS denied citing the following reasons......1.The CPIO , in his reply of 29 .2.08, stated that the questions and their answers are prepared and edited by AIIMS; thus product remains intellectual property of the Institute and for this reason refused to provide the questions claiming exemption from section 8(1) d and 8(1) e of the RTI Act. The Appellant preferred an appeal against CPIO 's decision with the FAA through his letter of 5.3.08. The FAA , in his Order of 1.4.08, upheld the decision taken by CPIO .2. the Commission holds that while normally there should be no reason for withholding question papers from the public, in this case the AIIMS is justified in not disclosing its question papers as it would affect the quality of Doctors going for specialization. The Commission is also convinced that no larger public interest is served by the disclosure of the question papers. these two statements are not understandable...if medicine is specific then its also very vasta dn an infinite number of questions can be prepared from it.....i want to know 1 thing sir....can i file an RTI and will it be of help after these two rulings...nextly sir can my RTI query be quashed citing these two rulings and if yes then what can i do?????? |

Yogesh, Did you see this thread also: Seeking info? no need to cite reason Each RTI applicant is different, the RTI Application is also different. Treat it like a game of skill (like chess or bridge) not a game of speed or strength. Use your ingenuity to frame the application.Just think: 1. Can 8(1)(d) be really claimed ? Is a question paper "intellectual property" or a "trade secret" ? Even if you assume for a moment that it is a "intellectual property" or "trade secret" then how will its disclosure hurt AIIMS IP rights or trade secrets ? Who else can benefit from disclosure ? There is no other competing authority which conducts such tests in India, is there ? So what will AIIMS lose by disclosure ? 2. Can 8(1)(e) be applicable ? Who has given information to whom in a fiduciary capacity ? Is it the examiner who set the papers giving to AIIMS ? Is it AIIMS giving to the candidate ?The word “fiduciary”is derived from the Latin fiducia meaning “trust”, a person (including a juristic person such as Government, University or bank) who has the power and obligation to act for another under circumstances which require total trust, good faith and honesty. The most common example of such a relationship is the trustee of a trust, but fiduciaries can include business advisers, attorneys, guardians, administrators, directors of a company, public servants in relation to a Government and senior managers of a firm/company etc. The fiduciary relationship can also be one of moral or personal responsibility due to the superior knowledge and training of the fiduciary as compared to the one whose affairs the fiduciary is handling. In short, it is a relationship wherein one person places complete confidence in another in regard to a particular transaction or one’s general affairs of business. The Black’s Law Dictionary also describes a fiduciary relationship as “one founded on trust or confidence reposed by one person in the integrity and fidelity of another.” After reading the above (this has been taken from a CIC decision http://cic.gov.in/CIC-Orders/Decision_30042007_03.pdf ) do you think that fiduciary relationship comes anywhere in the picture of answer papers/question papers ? You are not asking for the name of the examiner ! 3. The reason about "quality of doctors" is really laughable. ICSE, CBSE, IIT-JEE, GMAT, GRE, GATE, all such common exams question papers and answers are available in innumerable guides in any bookshop. Does that mean that Engineers, Lawyers, and other professions who have access to question papers/keys for their entrance exams are all of "poor quality" and their quality has been affected ? Just think about it and you will succeed. |
