CIC serves notice to Big B on UP poll campaign

LUCKNOW: The Uttar Pradesh Information Commission has served a notice to Bollywood superstar Amitabh Bachchan asking him what was the basis for his election slogan on TV channels to suggest that crime was less in the state.

His slogan ‘UP me hai dum, jurm hai yahan kam’ was aired by the news channels during assembly polls in Uttar Pradesh during April-May this year.
Chief Information Commissioner M A Khan gave the order on a complaint of one Brijbhushan Dubey of Ghazipur, who sought to know under the Right to Information Act, the basis of his claim and fixed October 15 as the next date of hearing.

The order, however, said that if Bachchan gave his reply to the complainant by a registered mail before Oct 15, he need not appear before the state information commission.
Dubey, on March 30, had sought to know from the superstar on the basis of which central report he claimed that crime was less in UP and to provide certified copy of the report to him.

He also sought to know how much payment was made to Bachchan and by whom, and what was the nature of his contract with the electronic channels.

After failing to get any reply from Bachchan, Dubey had approached the Commission, which fixed two hearings on the matter but no one appeared from Bachchan's side in any of that.
The CIC then served a notice to him asking him to either reply to the complainant before Oct 15 or appear before the commission on the next date of hearing.

Big B in trouble over his jurm hai kam ad

New Delhi: Legal hassles are refusing to get out of Amitabh Bachchan's
way ever since the change of guard in Lucknow.

Even as the case over the allotment of agricultural land to the Bollywood megastar is still waiting to be settled, a petition was filed before the Lucknow Bench of Allahabad High Court on Tuesday against Big B's
TV advertisements during the UP Assembly election, in which he had claimed that crime rate in the state was much less compared to the
other states.

Big B had quoted figures from the National Crime Records Bureau (NCRB) in the advertisements.

The petition, filed by Braj Bhushan Dubey of Ghazipur district, wants Bachchan to clarify the basis of his claim that UP mein hai dum, kyonki jurm yaha hai kam (low crime rate is UP's strength).''

Dubey had first moved a Right To Information (RTI) application with the Central Information Commissioner, Justice (Retd) MA Khan, asking for the basis of Bachchan's claim.

The CIC issued a notice to Big B on the basis of this petition, asking him to reply by October 15 on his claims that the crime situation in UP was better than other states

The commission also directed that the notice be sent by registered post to the actor, who was also the former member of the dissolved UP Development Council (UPDC), which was headed by senior Samajwadi Party leader and MP Amar Singh.

But without waiting for Bachchan's response, Dubey has now moved a petition in the high court in which he prayed that if Bachchan moved the HC challenging the CIC order, the former be given information to put up his contention on the date of hearing.

The Big B had played the lead in a series of TV campaigns on the crime situation in UP during the previous Mulayam Singh Yadav Government.

Dubey's original application had been sent to the commission on March 30 during the state Assembly poll, but it was registered with the CIC only on June 14. The High Court would hear the case on November 13.

Lucknow Bench reserves verdict on PIL in Bachchan ad case

The Lucknow Bench of the Allahabad High Court has reserved its verdict on a PIL, challenging an order of Information Commission , which rejected an application questioning megastar Amitabh Bachchan for his TV advertisement during the state Assembly election claiming crime rate in Uttar Pradesh was much less as compared to other states.

Hearing the PIL, Justices U K Dhawan and S S Chauhan reserved the verdict on the case.

The petition was filed by one Braj Bhushan Dubey of Ghazipur district, on whose Right To Information (RTI) application, CIC Justice (Retd) M A Khan had already issued a notice to Big B.

In his petition, Mr Dubey had prayed that if Bachchan moved the Hegh Court challenging the CIC order, the former be given information to put up his contention on the date of hearing.

Lucknow, Nov 27: The Allahabad High Court on Tuesday dismissed a writ petition challenging an order which rejected an application questioning megastar Amitabh Bachchan's assertion in advertisements that crime was less in Uttar Pradesh during the Samajwadi Party regime.

A division Bench comprising Justice U.K. Dhaon and Justice S.S. Chauhan, which had reserved its verdict, on Tuesday quashed the petition.

The petitioner had challenged the decision of the state information commission which had rejected his application seeking to know from Bachchan the basis of his claim in the advertisement in which he said: UP mein hai dum kyonki jurm yahan hai kam.

Bachchan's controversial advertisement had appeared just before UP Assembly elections' claiming that crime rate in the state was much less as compared to other states.

The Commission had rejected the application after going through the reply filed by Bachahan's lawyer to its notice.

The petition was filed Braj Bhushan Dubey from Ghazipur district, on whose Right to Information (RTI) application, CIC Justice (Retd) M.A. khan had issued notice to Big B.

In his petition, Dubey had made the request he be given all information regarding the case if Big B appeals in the court against the HC order.

The CIC in its order had asked Bachchan to reply by October 15 on his claims that the crime situation in UP was better than other states. In the advertisement the Bollywood star was seen quoting figures from the National Crime Records Bureau (NCRB) in the TV commercial.

At the time when the controversy erupted, Amitabh was a member of UP Development Council (UPDC), which was headed by senior Samajwadi Party leader and MP Amar Singh.
