Unanswered: fees for appeal/subsequent querry,P.O. rejected


1. do we need to pay fees for first appeal or for subesequent querry with PIO if applicant feels information provided is unsatisfactory?

2. can PIO reject an application saying P.O. paid as fees in favour of PIO is not encashable as it shall be in the name of Accounts officer(designated officer)? ( if finally money is going to government coffer in the name of RTI fees, shall it really matter?)

If the info provided by the PIO is not satisfactory, then the next step is only First appeal for which there are no fees. Any subsequent query, if in the form of another RTI application, then the applicant needs to pay the fees.

From the second part of your query, it is not clear in whose favour you have made the Postal Order. Precisely to overcome this difficulty, we have suggested several times in this forum to send only a blank postal order, requesting the PIO to fill up the correct name of the payee before encashing it.

The fees for the first appeal depend on which state you are in.
If you or any other member can help me in completing the chart for fees for
different states, it will be helpful to members.

2. The PIO cannot reject the RTI application because the Postal Order was not in the correct name.
a) He should continue gathering the information to be provided and at the
same time he should ask the applicant to provide the application fee in the
correct name.
In fact even if you give the fees within 30 days of filing the RTI application,
the PIO must collect and give you the information .
