Question papers of mh-cet and pgm-cet are not supplied

Whether the Question Papers of objective Questions of Common Entrance Tests for admission to Medical Courses and Post Graduate Courses in Maharashtra State conducted by D.M.E.R., Mumbai can be said to be confidential one and if not, as to how the Books of solved questions asked in previous so many years of such Tests of all India Level are being sold in open market and the candidates of AIEEE and JEE (I.I.T.) are being given after said Test is over and if Question Papers of MH-CET and PGM-CET as above are confidential, as to how the answers in Model Answer Keys and candidates Answser Sheets having only circles and circules i.e. objective type answers can be checked.

Moreover, it is not even supplied to guardians applying under Right to Information Act, giving the reason that it is confidential one.

Please send copy of reply to my email address please..........

This is most urgent and hence please advice me at the earliest.

As per various orders of the CIC, answer scripts, OMR sheets, question papers, etc are all disclosable. There is a Calcutta High Court order also.

Thanks for reply. I have filed the Second Appeal before the Hon'ble Central Information Commission for a direction to the Director of Medical Education and Research, Mumbai for grant of question paper of PGM-CET 2009 who does not even allows the candidates to take the Question Paper of said Test after Test is over or on application for valuation of marks alongwith fee of Rs. 1,000/- and without question paper it is impossible to cheque the Key Answer Sheet and Answer Sheet of candidates being it based on 4 objective type answers (having circles only) of versions 11, 22, 33 and 44. The said Appeal is sent by speed post to Hon'ble Commission which will be received by it on 15-4-2009 and on the same day, the First Selection List of candidates for admission to Post Graduate Courses is going to be declared. I had also filed Writ Petition before the Hon'ble High Court which did not entertain the same on the reason that it being related to R.I.T. Act, it cannot enlarge scope. My son appeared in said Test and received about 20 marks out of 300 marks as per his expected. On the objections by candidates on the basis of their time being memory, D.M.E.R. accepted 5 mistakes and if Question paper is provided, more mistakes in it and also Model answer key can be found out. However, due to such policy of D.M.E.R., merritorious candidates are going to suffer. So in this urgent situation, what can I do. I think that no stays are granted by C.I.O. in urgent matters and if tomorrow List is declared I would suffer a lot. Please advice me immediately and also support me. I want to add here that thousands of books having solved questions of such tests at All India level are being openly sold in the market and the same base is being taken in coaching classes. Besides it, AIIII, GEE and UPSC allows candidates to take with them Question Paper after examination is over. So to stop this, what should be done. It is very essential to have stay to tomorows list to be published by D.M.E.R. I have complied with all formalities in Secnd Appeal and it would better if Hon'ble Central Commission takes this issue. I want to add here that Hon'ble Bombay High Court in Writ Petition NO. 1658 of 2001 (Jimmy Abraham Thomas V/s State) in the year 2001 had directed the respondent D.M.E.R. to consider to publish Question Paper but the same is being not followed. Please advise me and support.
