Finance required for question for RTI Act

Dear Friends,

Hi,

Shri Subodh Jain, RTI activist asked a question to Delhi Police that how many mobiles were theft in one year. Delhi Polce asked for Rs. 1,68,000/- for this information (source Navbharat Times dated 15-11-2007).

Can any department asks fund for any question under RTI Act.

It is very funny situation with the Act.

I liked you signature very much.
Very well said.
I've earlier said that out govt. system is junk for last 60years & can not make run in one or two years. Our continuos RTI Applciation efforts will make it run & will be a threat for newly coming govt. employees. So both parts will move, with time.

As per Section 27 & 28 of the RTI Act 2005, Central or each State Govt. has framed "Rules" for the act. As per those rules, the Public Authority can charge for providing information.

For Delhi, the rules are available at:

If a Fee is to be charged as per Section 7(1), then, as per section 7(3) (a) and (b), the PIO should inform the applicant along with a reasoned order and calculations as to the basis of the fees to be charged.

Please check if the PIO of the Delhi Police has done that and on what basis has he calculated the amount of Rs. 1,68,000/-.

The figure is very high and there seems to be some mistake somewhere.

The basis of arriving the fee amount has to be provided with the request to deposit the fee. The same communication is also a decision which can also be appealed with the appellate authority.

In this case, as per the Act you have not much choice other than resorting to First appeal. However, it is advisable to resort to seeking from PIO inspection of the dicuments by filing an application for it.
