    Chief Secretary of Jharkhand

    Dear Expert Members,

    I filed an RTI application to the Chief Secretary of Jharkhand on 5th March,2009 (pls see attachments) but he did not reply. I sent him a reminder on 20th April, 2009. He still did not reply. Please guide me what to do next and where to complain. Thanks in anticipation..

    your application & reminder had your personal details (add., phone & mob. no.) so deleted these details (Edited ver. as attachment)

    File First Appeal (if its not time barred) & if FAA doesn't give his decision in time send him reminder (try to solve matter at FA level), after his decision if PIO not provides the requested info then again send reminder to FAA. hope u will get the required info.

    Since the PIO did not reply to the RTI Application dated 5th March 2009 and also your reminder sent on 20 April 2009, technically you can still file First Appeal before 20 June and ask the FAA to condone your delay.

    But you do not know the FAA of the Chief Secretary's office.
    You can address it to the Administrative Head of the office, that is the Chief Secretary himself by name and designation.

    Alternatively send it to the Jharkhand SIC either asking them to forward to the FAA of the Chief Secretaries office OR file a complaint under Sec 18 directly to te Jharkhand SIC.

    I am also thinking whether it will serve any purpose to send the First Appeal to the Governor of Jharkhand, since the state is under Presidents Rule.

    Dr. Sahab,

    Assuming the application was received by the PA on 12 March 2009, the PIO should have replied by 11 April, and in absence of such letter, you should have filed a first appeal latest by 11 May 2009. Therefore, in all probability, the first appeal is time barred.

    You may still file the first appeal, and hope that the FAA or PIO do not capitalize this delay.

    3. I assure that I shall not allow/ cause to use/ pass/share/display/ or circulate the information received in any case and under any circumstances, with any person or in any manner which would be detrimental to the Unity and Sovereignty or against the Interest of India.
    Regarding this declaration in your application - is it necessary? what is the legel implication? If it comes to substantiating this in a court, how do you define 'interest of India?
