Army welfare education society(awes) status under rti act

Dear Friends,
I have gone through some of the threads /links on forum discussions on AWES. I have also put an Appeal to the First Appellate Authrity(FAA)( HeadQuarters South Western Command , Jaipur) since the CPIO /Public Authority ( Commander Jaipur Sub Area )/;Chairman Army School Jaipur replied to my application that AWES who is running the Army Schools / APS is not covered under RTI Act.
I have now in my request to the FAA given sufficient reasons why AWES should be responding to RTI Applications since A1 defence land is given by the Army to AWES for Army Schools in Cantts/ Military Stations free of cost , Complete Government funds have been used by the Army Authority for constructionof School Buildings, all Army Schools are under a Serving Brigadier as Chairman of School Management Committee . I am waiting for the response of FAA before approaching CIC on status of AWES / Army Schools under RTI Act .
May I seek help from the esteemed members of this forum about latest decision of CIC on Gen BC Joshi Army Public School or AWES institutes cases already discussed / decided . Are these under RTI Act or not ?

as per RTI
“Public Authority” [Section 2(h)]:
• any authority or body or institution of self-government established or constituted
(a) by or under the Constitution;
(b) by any other law made by Parliament;
(c) by any other law made by State Legislature;
(d) by notification issued or order made by the appropriate Government;
and includes any—
(i) body owned, controlled or substantially financed;
(ii) non-Government organisation substantially financed,
directly or indirectly by funds provided by the appropriate Government.

I strongly feel this society comes under RTI.

The majority opinion on this forum agrees completely with you, that the AWES is a Public Authority under RTI. However, the army has consistently taken the opposite view, regarding AWWA, AWHo, etc. You may find the following threads useful.

Probably it will take a writ petition/ special leave petition to make final decision on this issue.

Thanks a lot Atul Patankar and Prabha for your moral support . I for sure knows that AWES is using defence land ( property of Govt of India / Min of Def ) allotted to children schools in all cantts/ Military stations . All Army ( public ) Schools are running in place of these children schools . School buildings are constucted from Min of Def ( Quarter Master Genral Capital Budget) Major works funds of Army. AWES has not paid a penny either for this Defence land or construction of school buildings any where in cantts. All these Army Schools are run under the management of School Management Comittee chaired by a serving Brigadier. The interviews etc are all conductted by Army officers. Can these still be out of RTI act coverage ? Will take up this matter with CIC in days to come since it is already under consideration with First Appelate Authority at the moment.
This is similar to status of Sanskriti School Delhi where in CIC has given a decision that Saskriti School is under RTI Act so why not Army Schools / APS .

AWES schools as you said are on defence land. allotment of funds and land comes from teh Army hq, signed by officers in their official capacity.

but when you go to the cic, you need to have all details regarding the points you have mentioned in your post. probably you need to use rti to get authentic info on all these points.address your queries to the stn hq of a few military stations around your place or the defence estates officers.

armed with this info you'll be able to get a better deal with the cic.
