Any type of information , available with the office in any format can be asked for by the applicant from public authority. General guidlines for maintenance of record provisions of Pubilc Records Act is followed. In addition to it departmental approved policies for upkeep and maintenance of record are also to be checked.
Whether the information is old or new, existing or weeded out , reasons for the same have to be provided that why information is not provided to the applicant.
IF information is intentially weeded out or misplaced then, CIC may take notice of such dereliction of duty and ask PIO to submit the record for weeding out of the information and other details like by permission of which authority , information was destroyed, what was the retention schedule or weeding out policy followed by insitution. Commission may ask for filing of the affidavit to substantiate the claim of PIO.
If found deliberate denial or weeding out without authority etc= discplinary action may be initaited on its recommendation
No such time limit specified in RTI act it depends on the record retention schedule of that PA.Information cannot be denied on this ground that it is old. Information which is available with PA (not weeded out ) will be provided to application.Information older than 20 years cannot be denied even though it is exempted under clauses 8 or 9.
