Thumbs up Unanswered: CAN CPIO REPLIES WITHOUT ANY outward number, INSTEAD OF THIS HE IS JUST QUOTING SAME FILE NUMBER FOR EACH COMMUNICATION IN RTI MATTER ?


The CPIO of one Ministry is given reply without any outward number, there is only same file number is quoted on the each reply of letter,

because of this the CPIO is quoting previous dates
for each reply (date quoted is within time limit of 30
days) and reply it to applicant after two months & get
the benefit of reply within time limit of 30 days.

Is it possible to restrict the CPIO to doing these things
or is it compulsary to CPIO to quote outward number
on each reply ?

He can give the same file number to each of the communications pertaining to the same RTI application.
He must be mentioning a different date in each communication.
So, how can he take advantage of the first date ?

Apart from this you also have a record as to when you received that particular communication - like date stamp from post office, etc.

The CPIO may furnish the information any way he desire. So long as you get the information sought for as per RTI Act where is the problem ?

I mean to say after 30+07=37 days is over, i have appeal to FAA , after the 10 to 20 days CPIO gives a reply with a letter dated (date is within time limit of 30 days RTI application).
Thus CPIO get the benefit of Penalty levied on him by FAA or CIC's IC.

Maximum Govt. Ministries and Departments are having Postal Franking Machine for stamping.
CPIO also get the benefit of this machine by Franking the Envelope on this Postal Franking Machine (in 30 to 40 days of RTI application received by CPIO ) which is to be sent to applicant.

Also CPIO is having a reason of Postal delay etc.

In RTI , the essence of action is TIME and not the Outward Number or any sequential number.

If outward number is the criteria, CPIO can always leave a couple of numbers blank to manage RTI Cases later-on. CPIO has to adhere to the time limit of 30+5 days to decide the mater, otherwise, it becomes deemed denial. In any application, if you do not get information or a decision from CPIO within 35 days, you may prefer First Appeal before the First Appellate Authority for deemed denial.

Please ensure that you submit all your RTI Applications by Registered Post Ack due or Speed Post or Hand Delivery under acknowledgement.

If you are keen to know about the actual date of dispatch of any document to you, you can seek copy of Stamp Register which has entry of stamp used for each Registered Letter or even ordinary letter dispatched by the PA datewise.
