Encroachment problem Some illegal authorities encroched the Govt Road infront of my site, they build a commercial buildings on encroched governamental road from year 1990. i enquroed the municipal authorities they accoknowldes the thats governament land the whole road is enchroched and its as old as from 1990, we dont have document prove thats governament road.
but in my site map approved by the municial authorities that in year 1987, in that map that very clearly shown the govt road.
now what will adive you to me,
shall i apply information regarding the
1) the aownership and site approval on the encroched buildings?
2) while ina suit in court?

Dear Shrishail
File RTI with the local Municipal Authority & ask for the details of encroachment/s.
You RTI application to Municipal Authority has to be as per Karnataka (if Gulbarga is in Karnatka) Govt. RTI rules ( 150 word limit), fee & format ( Form A) & will be addressed to State Public Information Officer (SPIO or PIO). Please see:

RTI procedure is :Time limits specified in the RTI Act - RTI Guide
1. RTI Application with Fee to PIO
2. If no reply/ not satisfied with reply in 30 (or 35 days in case of submission to APIO or under Section 6(3)),
First Appeal to the First Appellate Authority (normally a officer higher than the PIO)
3. If no reply/ not satisfied with reply in 45 days to the First Appeal, then Second Appeal to the CIC/SIC (time period is 90 days)
While filing any RTI application please remember:
1) Make sure you ask for information not for opinions/clarifications.
2) Check the relevant RTI Rules regarding fees and make payment accordingly.
3)Application must be sent by Registered or Speed post so that you have a proof of delivery or you can submit it personally in PIO's office after receiving
due acknowledgment.

ask for
1. Village map from ADLR office.
2. Town map from Panchayat/Municipal office.
3. Route map from KSRTC
4. Road map from PWD department.
From the following document you can prove whether it is govt road or not, use RTI for this.
Next is Collect the site number given to that property, apply for the encumbrance certificate from the Sub Registrar Office, if any transaction is there collect the Sale deed also. Next From Municipality apply for building plan, No objection certificate and CR.

bbmp
bbmp worker are working near our area to clear the drainages which were blocked.i had a compound wall constructed on the drain to prevent ragpickers coming and causing new sense.As per the instruction of bbmp i have removed the wall.My neibhour has contrcted a shed with roof.I don't know why the bbmp engineers are not objecting for that i would like to know the reason.The area address is XXXX.At present i am away from the country.please gudie me the further action i should take.
