My IT refund is pending for the last1 yr .I will like to file the RTI for the same.How do i find the address & the name of the assessing officer, who I should send the application to.It was filed in Panvel,ward no. 1.I am unable to find it using the link provided. Income Tax India Please help. Shiny |

Income tax department has designated all assessing authorities as PIOs. Therefore, your assessing officer is the CPIO whom you should address your application under RTI . Your assessing I.T. officer is also the CPIO of your IT ward. U can address appln and envelope as CPIO /ITO, Ward No.________, Income Tax Office and then write the address of IT office concerned. Name is not material as officers do get transfered/deputed etc. Never write name, it will create confusion.Stamp affixed on acknowledgement copy of Tax Return shows your IT ward No. If U are a salaried person, u can write salary ward [mention first letter of your name as it appears on PAN card]. In small places, there is one salary ward, in big places it is subdivided as per alphabets of name of assessee e.g. A to M, N to Z etc depending upon workload.

Thanks to response for you all, I filled the RTI for Income Tax refund.I got the reply from IT office stating that the refund has already been sent to my address through registered post, six month back.I went personally to the office ,for enquiry, as I have not received any refund ,till date.But the they maintain the same answer.What needs to be done? |

Dear Shiny 1. File a detailed complaint with ITAX dept. (same office) & enclose the certified copies of your bank a/c statement & ask them to reissue the cheque. Send it by speed /registered post. Wait for 15/20 days, if no reply. File an RTI application with CPIO of ITAX (RTI application as per central govt. rti rules & fee) for action taken report on your complaint .Please refer to the blog Any thing pending with Govt. RTI application with same CPIO & ask for the copies of their outward register (relevant page/s) as proof of dispatch, copy of postal slip. After getting this info file RTI application (if was not sent by speed post) with postal dept. for delivery report.3. U can file both applications at the same time. Try to get a copy of assessment order/ intimation under section 143. This, original is attached to the refund cheque, and duplicate should be available on Income Tax department's file. This will be having the cheque number and possibly the bank on which the cheque was drawn, usually treasury branch of State bank of India. Then submit an application under the Right to Information to the concerned bank, for copy of clearing register showing details of clearing of the cheque in question. The reply to this will either prove who got money or prove that the cheque was never presented for payment, and it now has become stale. Be prepared for a long process. |
