CHIEF INFORMATION Commissioner (
CIC) Justice (retired) MA Khan issued a non-bailable warrant against LDA joint secretary Yogesh Shukla for not appearing before the Commission despite repeated orders.
"The LDA joint secretary was personally asked to appear before the Commission on November 12 in a complaint number 732 C/07 filed against the LDA by Ganesh Shankar Srivastava. A showcause notice was also issued to Shukla as to why contempt of court proceedings should not be initiated against him. But despite the notices while LDA's counsel AK Singh is present, the joint secretary himself did not appear when the matter came up for hearing on Thursday.
Hence, a non-bailable warrant should be issued against Yogesh Shukla and he should be arrested and produced before the commission on January 15 when the next hearing in the matter would take place," says the order passed by Khan.
A resident of Ismailganj in Chinhat, Srivastava was working as a supervisor in the LDA on the basis of a government order.
Subsequently, his services were terminated by the development agency following which he had sought information from the LDA related to his appointment under the
RTI. But he moved the State Information Commission after the LDA failed to reply to his application. Srivastava claims he had filed a case before the High Court here after his services were 'arbitrarily' terminated by the LDA. The court, according to him, gave a judgment in his favour but the order was never complied with by the LDA.
