We are staying in a private society. A member of the managing committee of the society without calling for an AGM took a decision to install a Aircel tower on a yearly charge of 4 lakhs. He has not obtained any permission from the BMC. Is it legal? The tower is to be installed on a terrace which has been encroached by the said commitee member as his flat is facing the terrace . He plans to pocket the money and claims that the installation is being done on the terrace which is only acccesable to his house. What can be done? |

Hi, I live on top floor (7th) of my Building. The society memebers are trying to put a cell tower on the terrace to get extra income.I personally object this move due to the EMR caused by these cell towers.They have got the signatures from other oweners in my absence.So please tell me can they go ahead for same without approving by all the oweners.Can I get the legal BMC guidelines for the same. Before any such installation. the society has to call for an AGM and discus the matter and take a vote. The society cannot on its own take a call. The next step is for the the company to obtain permission from the BMC. If the society has not obtained from the AGM and have the certificate from BMC. The installation is deemed to be illegal and can be demolished. You can start off by writing to the society to provide you with a copy of the minutes of meeting in which this decision was taken. I too was not aware of the same but have the answer now which i am sharing with you. Arzan |
