    ACR to be disclosed - DoPT circular

    As a sequel to the Hob'ble Supreme Court's orders the DoPT has issued a circular that ACR should be disclosed to the assessed persons.

    Apparently the DoPT OM mentioned above does not exclude the Defence Officers! Why worry?

    The basis of the DoPT OM is this Judgement --Dev Dutt Vs Union of India by the Hon'ble Apex Court. The decision is by Shri. Markandey Kadju. Every word of the judgment is worth its weight in gold. Read it.

    On the basis of this judgement i applied for ACR under RTI. The pio and apealate rejected on the ground that they cannot take such policy decision inspite this Judgement. In apeal before Information Commission (Division Bench of 4 ) i pressed that the reason of rejecting application is not in confirmity of section 8 so it deserve to be set aside. Once Hon. supreme court has said that it is fundamental right guarranted under Constitution to know every entry in ACR, there should be no hesitation in allowing apeal. The information commissioner of Maharashtra said that they will check the legal position and communicate the decision. I am waiting for decision [Apeal heard on 25/06/2010]. Is it not necessary for them to deliver operative part of decision in open court during hearing ? as is practice in Judicial Courts.
    Can you guide me on how long i will have to wait for their decision before approching Hon. High Court in Writ for restoring fundamental right as accepted by Hon. Supreme Court in Devdatt case.
