This is to inform you that I am working as a Software Engineer in USA
for the past 12 years. I have purchased one Plot bearing No.H-15 at
Sivakasi Ph II from Madurai Special Division, Tamilnadu Housing Board
in 1998. I had already paid the entire cost of Rs.1,30,675/= towards
the aforesaid plot in 1998 as per their No Due Certificate
No.R5/2129/98 dated 5-11-1999. I am very sorry to inform you that
in spite of my repeated requests, I have not received Sale Deed from
the Executive Engineer & Adn. Officer, Madurai Special Division,
Tamilnadu Housing Board, Madurai-625010 so far, although more than 11
years had passed.

OUR SERVICE COMMITMENTS ARE:
we shall
1. Issue sale deeds for the plots/houses/flats within 30 days,
from date of application."


I have already sent so many e-mails to the concerned higher authorities in this
regard. To my great disappointment, I have not received even an acknowledgment
or reply so far.

I therefore request you to kindly look into the above matter and do the needful
immediately

U can use RTI in this matter. First submit a detailed written complaint (on paper in hard copy) & send it by speed/registered post. Wait for 15/20 days, if no action file RTI application with PIO of concerned authority.

If U have submitted any complaint (in hard copy whether submitted by hand or sent by speed/regd. post) earlier then directly file RTI application with PIO of concerned authority.

writting application is simple.

Example:
Mr.X has paid entire cost regarding the purchase of one Plot bearing No.H-15 at
Sivakasi Ph II from Madurai Special Division, Tamilnadu Housing Board
in 1998. Inspite of repeated request the sale deed for the same is not yet been given.
kindly sent the answers / document copies for the following Under RTI act 2005.
1. provide me the document copies which contains the purchaser and owner of Plot bearing No.H-15 at Sivakasi Ph II from Madurai Special Division, Tamilnadu Housing Board
2. provide me the Receipt copies for the payments towards the Plot bearing No.H-15 at Sivakasi Ph II from Madurai Special Division, Tamilnadu Housing Board.
3. kindly provide me the Copy of No Due Certificate No.R5/2129/98 dated 5-11-1999
4. Please provide me the Copy of document which contains the details that within how many days after full payment, the Sale deed should be issued to the purchaser.
5. please provide me the sale deed copy of the Plot bearing No.H-15 at Sivakasi Ph II from Madurai Special Division, Tamilnadu Housing Board.

7. if the sale deed of the Plot bearing No.H-15 at Sivakasi Ph II is not issued / delivered, kindly provide me the name, designation, then and present address of the OFFICIAL(S) who is responsible for not issuing / delivering sale deed in stipulated period.
8. kindly send the copies of the rules and regulations which states, what kind of departmental action taken against the official who is not providing sale deed in stipulated period.

Conclude the letter as..
If any details are not available in your office, I kindly request you to take action as 6(3) of RTI act. Here with I affixed Rs 10 court fee stamp as an application fee. In addition to this any additional fee if I have to pay, kindly inform me for how many pages, how many rupees for that, at what head I have to pay.

Address this letter to the Executive Engineer & Adn. Officer, Madurai Special Division,
Tamilnadu Housing Board, Madurai-625010.
Give the full address of sender.
Paste a ten rupees court fee stamp ( which is readly available in big stationary shops / in front of any court in TN)
Send this application in Registered post with acknowledgement card.
Preserve the lr copy and acknowledgement card.
Post your feed back here after 35/ 40 days.

This is with reference to your letter cited above, on the captioned
subject. It is surprised to note from your letter in question, that
the final cost of the land not finalized due to pending case in the
court. At the time of purchase of the land in 1998 from TNHB, you
have not informed anything about this matter. After a lapse of 11
years and after received the total cost of the land fixed by TNHB,
now you are saying that final cost of the land is not finalized and
still I have to pay additional cost of the land. This is not fair
dealing and businesslike.

Suppose I bought a land from a private sector in 1998 after paid the
total cost of the land, will the private party demand any additional
cost? At the time of
purchasing the above plot, ie. In 1998 there were ample scope of
availability of more lands for sale at the very cheapest price near by
your New Housing Board colony. Now I feel worry too much why I had
bought plot from TNHB. If I bought the same, now I can get fantastic
gain. Now I have been cheated by TNHB.

I am not in a position to pay any additional cost towards the plot
allotted to me. I am ready to surrender the above plot to you. You
have allotted only vacant land and not a house. I have not enjoyed
anything with the plot allotted to me. I therefore request you to
kindly return back the amount paid by me towards the cost of the said
plot alongwith 24% Interest p.a. Immediately. Your immediate action
in this regard would be highly appreciated.

I am sorry to inform you that I have not received any reply from TNHB,
Madurai Unit so far, although more than one month had passed. That's why I have
sent so many e-mails to all concerned higher authorities with regards to my
grievances. While I send my application to TNHB, Madurai Housing Unit
under RTI how I have to prepare my application, based on the above
correspondences I shall be very much
thankful to you, if you could help me in this regards..

Dear Balamurugan, please confine yourself to only one user id as suggested by Mr Ambrish.

The suggestion of Antony Devaraj to send an RTI application in the name of "anybody in Sivakasi is likely to be counter productive. Such an RTI application seeking information about your land deal by anybody else is bound to get rejected as a third party information.

As regards your land price, please check up the original offer letter from TNHB to find out if they had given you a final cost price at the time of sale offer or only a tentative cost and also if their offer or sale agreement contains any cause for cost-escalation at a future date before execution of the sale deed.

TNHB, Madurai spl. division has mentioned in their Plot allotment letter dt.31.7.1998
as "The Tentative cost of Plot is Rs.1,20,700/- as on 31-7-1998". I have paid
Rs.1,30,675/- I believe the excess amount paid by me may be towards interest. Now I don't want to pay any extra amount. I want to surrender the plot allotted to me and get back the amount paid by me along with 24% interest p.a. from 1998.

Sub: RTI Act 2005-Tamilnadu Housing Board- Plot Purchased in 1998-Non receipt of Sale Deed- Non receipt of information sought for-Grievances Reg.


I submit to inform you that I am a NRI based in USA. I have purchased one Plot No. HIG-15 at Sivakasi Ph II from Tamilnadu Housing Board from Madurai Housing Unit, Madurai in 1998. I had already paid the entire cost of the above Plot in 1998 itself. I am sorry to inform you that despite my repeated requests I have not received the SALE DEED in respect of the above plot bought from TNHB, although more than 12 years had passed. In this connection I have sought certain information/copies of documents from the Executive Engineer& Adm. Officer, Madurai SpecialDivision, TNHB, Madurai-625010 as per my letter dated 09-07-2009 under RTI Act,2005. I have sent the above application through speed post vide Receipt No. SP-POD EI 793465480 IN dated 09-07-2009.

I have also sent an application dated 14-07-2009 seeking information/copies of documents to the Managing Director, Tamilnadu Housing Board, 493, Anna Salai, Nandanam, Chennai-600035 through speedpost vide receipt No.SP-POD EI 793486224 IN dated 14-07-2009.

My above application has been forwarded by Shri C.N. Koteeswaran, Public Information Officer & Executive Engineer (Q.C), TNHB, Chennai to the Public Information Officer, (Divisional Accountant) Madurai Housing Unit,TNHB, Ellis Nagar, Madurai as per his letter No.RTI/29803/09 dated 16-07-2009 (Application Received ID No.585 dated 16-07-2009) with a instructions to send the reply/information directly to the petitioner within the stipulated date without fail.

I am very sorry to inform you that I have not received even a courtesy reply from the above PIO, Madurai Housing Unit, TNHB even though 45 days had passed. I am not aware of the reason for his irresponsibility and negligence. The above PIO did not give respect andhonor the RTI Act,2005.

I therefore request you to kindly look into the above matter and arrange to get me the details/copies of documents sought for in my above application immediately. Hope you will take immediate action in this regard.

What you have mentioned in the previous posts appears more as a letter to the SCIC than a complaint/appeal made to the SCIC under RTI Act. You have already been provided with various links in the directory/guide section for Tamilnadu RTI rules. Please follow them to the dot if you are making an appeal/complaint to SCIC.
