I have filed an RTI application with BWSSB (Bangalore Water Supply and Sewerage Board) asking for details of action taken by them on my telephonic and email complaints regarding laying of UG pipes. I am waiting for the response, but I thought I should share some of my concerns with members and seek advice.1. BWSSB website does not provide details of information officers. In fact there is no RTI link. Is this a violation of RTI rule? Whom should I complain to?2. In the absence of details from their website, I decided to file the RTI application with the APIO at their head office. I got a copy of a letter written by the PIO at the head office addressed to the PIO in their engineering department, transferring my application to the latter.3. I filed the application with the APIO but it is being attended by the PIO . Is this acceptable? I may have problem when I decide to file first appeal since I would be addressing the first appeal to the PIO . Whom should I address the FA in case I don’t get a satisfactory response?3. Also, the application was transferred to another PIO in the same organization asking the second PIO to provide the information to me directly. In all probability the first PIO will wash off his hands. Am I justified in expecting the response from the first PIO only?Please advise. Regards - Mahadevan |

If the information has been provided by the PIO , then it is OK.3. If it does not make any material difference to you, then the "other" PIO can reply. He is considered as "deemed" PIO since he must be the custodian (or his department must be the custodian) of the information you sought. This is also allowed.Did this "other" PIO provide you the information under his own signature and stating that he is PIO (below his normal designation) ? If yes, then it is correct. |
