CPIO rejecting RTI applications even for sec(4) information

The CPIO ,KIOCL LTD,II Block, Koramangala, Bangalore-34 had sent 20rupees cheque(stating he is returning the rti fee amount) on the name of applicant AFTER first appellate authority rejected the first appeal stating the third party denied the information to be supplied ( I have attached different CIC decisions hardcopies and quoted the extracts from the decisions in first appeal ).

Now tell me how to react to the cheque sent by the CPIO . Shall i reject the cheque stating that the matter escalated to CIC in the form of second appeal (i have sent it yesterday).

WIll be there any issue of the reply of cpio with cheque at CIC while making a decision on my second appeal .

plz suggest me solution.

1. There is no provision of returning Application fee.

2. 2nd Miracle reported:

a. FAA ordered the PIO to supply info against unsigned RTI application.

b. PIO returned the application fee to applicant as it was rejected by FAA .

Dear Darbar,

1) How come CPIO returned to you Rs. 20 cheque? Normally RTI fee is Rs. 10.

2) RTI fee is not payable through cheque. It has to be paid in cash or through DD or IPO.

3) Has CPIO said that cheque is not acceptable mode of payment of RTI fee?

Your returning the cheque to CPIO will not serve any purpose. Most probably CPIO would take a stand that cheque is not acceptable mode of payment of fee before CIC.

After getting your replies to above queries the appropriate advice should be given.

Mr. Darbar has paid RTI fee by postal order & PIO has returned Rs. 20 by cheque from his side.

In that case returning the cheque drawn by CPIO would be correct option.

There is no provision of returning the application fee.

Just send the cheque back and inform the PIO that you are going to file Second Appeal and will serve him a copy.

thanx for the suggestion. I have returned the cheque drawn by CPIO stated that i am going to file second appeal and will serve a copy to him.

(this cpio wants to escape from the responsibilty. Earlier he has rejected to give information & returned Postal orders i sent as fee.

after filing first appeal and getting the decision from the FAA , the cpio again replied to me by sending the 20rs cheque. May be he wants to clean off his hands from the episode if i approach CIC for second appeal ).

could i add the xerox copy of cheque with fresh cpio reply in SECOND Appeal and pray the cic to take disciplinary action against cpio .

Yes, please do that.
It will strengthen your case regarding malafide denial of information by the PIO .
