CPIO rejecting RTI applications even for sec(4) information

Hi all,

The CPIO of KIOCL Ltd(kudremukh iron ore company ltd), II block, koramangala, Bangalore - 560034 is rejecting every RTI application i send in which i sought information like employee names,designations & salary list which is to be proactively disclosed under sec (4) of RTI act.

The other RTI applications i filed are 1) information regarding attendance particulars of a section of employees.
2) pattern of leaves, number of leaves and authority who issue leaves.
3) property return forms submitted by some employees.
4) certified copy of CSS service conduct rules 1964 for that company.

But the CPIO rejected all the RTI applications stating that the information falls under purview of section 8(1)j and section 11 of the RTI act. He even sent back the Postal orders i have attached to RTI applications as fee.

I have even attached hard copies of CIC decisisons in support to the information i sought, but the CPIO bluntly rejected all the RTI applications.
I have filed one First appeal again with attaching the CIC decisions(which i downloaded from this site) but of no use , the appellate authority also rejected to provide information stating it is under section 11 of the RTI act.

Now please help, I need some volunteers who can jointly file RTI applications to teach or to bring awareness to this particular CPIO of KIOCL Ltd, II Block, Koramangala, Bangalore-560034, which is a central govt public authority under ministry of steel.

Will complaints to CIC work in this case if CPIO rejects to provide information intentionally.

Hi. Have you checked whether your facts are correct? I was told that salary and other personal details do not come under the purview of RTI.

Hi, check the RTI applications which were sent in the attachment.
Soon I will upload the replies from the CPIO, KIOCL Ltd, koramangala, Bangalore in the form scanned copies.

this RTI application is for attendance details.
have attached earlier CIC decision number CIC/OK/A/2007/01174 Dated: 22 November 2007 for reference,
But the CPIO rejected with the same reason section 8.

When the PIO rejected your applications, did you file a First Appeal under Sec 19(1) with the FAA ?

this is first appeal made under sec 19. plz edit if need changes to get required information.

You can go ahead with that First Appeal.
Only ine suggestion - instead of just giving the CIC order reference numbers, give the reference number and also the relevant extract of the order.

yes sir, i am attaching the hardcopy of the order with the first appeal.

You can attach the hardcopy for reference but also reproduce the relevant portion of the order within the appeal itself.
