oftentimes i receive applications under RTI asking for copies of certain certificates; ordinarily citizens who ask for these certificates have to pay some money for them. when they are demanded under RTI, the PIO is put in a dilemma. the question is: which shall prevail? the RTI or the departmental or government rule that charges are payable for issue of certificates. clear cut guidelines are not available in the act itself. the problem frequently occurs in medicolegal cases. another related question is: can the RTI act be used to bypass the dept or govt. rule and thus deprive the government of its revenue? i seek guidance from learned members.      |
