Unanswered: Whether information is to be signed

1. With regard to the information sought for under RTI Act, do unsigned statements/letters constitute an authenticated reply to the queries?

2. Can an organisation refuse to furnish information on the pretext that the information sought for is not available and that it has to be processed/generated?

1. Please do not accept unsigned statements / letters as replies to RTI applications.
They have to be signed.

ravidurairaj, 1. unsigned statement in reply to RTI application is not worth the paper it is written on. 2. generally a PIO is supposed to give information available and 'held' byhim. if it is not there, he cannot very well give it, is it not? but of course, when you receive such reply, you have to make sure that the PIO is not trying to evade his duty. if you have any suspicions, go for first appeal against such decision of the PIO.

At the outset, thanking you for ur prompt reply. Regarding ur reply, kindly clarify the following aspects:

1. Regarding unsigned statements/letters, though the covering letter is signed by the PIO, the supporting documents attached as annexures to the reply are unsigned. Hence whether these would constitute as evidence in a court of law in the future?

2. I had asked for a list of employees who have been given adhoc promotions. However, instead i was given copies of office orders of a selected few.

1. Do the statements forming a part of the annexures to the main reply have to be signed also or just the signature of the PIO on the covering letter suffice?

2. If a list is being asked for and instead only copies of the selected few forming a sample of the list is furnished, is it a evasion of duty by the PIO?
