| Hi, In chennai - Velachery, one of the prominent builders have encroached road apart from their plot and constructed buildings. In addition to they have also put a security gate in the middle of the dead-end road, otherwise would have been a public road. I want to know whom and How CMDA to be approached for knowing: 1. Whether building approval is given for the construction? 2. If any violation from builder, can road be reclaimed by CMDA intervention? 3. Whether the security gate put up without any permission on the road can be taken away? How RTI act can be effectively used to seek this information and clear the encroachments. |

You can definitely file a RTI application as per Tamil Nadu Rules with CMDA to get the information you have listed. Please do no delay the case. You should ask for inspection of the approved plan. Read the Municipality Building Rules. The Building rules lays down all the parameters. Note down which are the provisions violated. Make a written complaint to the Municipality of "Unlawful construction". After sometime persue it by filing an RTI application seeking the information on the action taken etc. If it is delayed you will find it very difficult to get it demolished. Please pursue it vegerously. |

try to pull both CMDA and Corporation of Chennai simultaneously for better results. Don't coin your questions deep in to the approvals and sketches they may refuse invoking sec 8. pull the inspecting authoriy and ask for the penalities and punishments of violating the approval regulations. send a private mail with more details for a personalised questainore. regards R.L.SARAVANAN ADVOCATE |
