Hi there,
I have made application to PIO of Building proposal dept. on 10th
August,2009......I recd reply in person on 10th of September,2009...........which
says some papers are available....the problem here is with certification
charges....they have asked in reply For IOD/CC/Approval letter ---Rs.25/- per page
and For Approved plan---Rs.60/- per page....which is exhorbitant according to me
....bcoz there are atleast 200 pages and approx 25 plans
I made an complain after this reply as follows.....
Ref : Your Letter Dated 07.September,2009. under Right to
Information
Act 2005.
Dear Sir,
With reference to your reply for my application filed under Right to
Information Act, 2005.(further referred as ‘ RTI ’ ) I have to write to you as under :
After receiving letter from your office on 10 September, 2009 I went to
‘E ‘ Ward office , Building Proposal Department and met dispatch clerk and
explained my difficulty regarding the information required by me under RTI. The
dispatch clerk was kind enough to listen to me and after listening to my problem he
directed me towards the Mr. X (PIO)Executive Engineer (Building Proposal) .
I then personally met the Exe. Engineer and explained to him what
was the required information by me under RTI, he told me to check the files bundle
and get the required information by myself. I explained to him since I have limited
knowledge in this regards it would be very kind of him if he could help me in
arranging the said information I have asked under RTI.
After listening to this Mr. X told to me “ everday we receive hundreds
of application regarding the RTI and he doesn’t have only this work and would be
unable to help me “.
Mr. X told me to bring the competent person to inspect the files bundle and
get the information required by myself.
Sir, I am a person of limited means and would not be able to appoint such
competent for inspection of records, kindly please provide the information required
by me under RTI it would be of great help because at present day the suit is
pending in The City Civil Court at Mumbai with regards to the same building
premises for which I have asked information under RTI.
Further to the best of my knowledge as per the Right to Information Act , 2005.
inspection of the documents is not a precondition for getting their copies and
information and I request you to provide copies of all the documents as requested.
. I am enclosing the copy of RTI application filed by me and letter sent to me by
Office of Exe. Engineer for your record and perusal.
And Urgent action will be appreciated.

1.1st Appellate Authority,
2. The Vigilance Department, (Special Duty)

application in same premises.....In reply pertaining to a different RTI from Chief
fire officer .....which belongs to same building of above mentioned building
proposal dept... In fire Dept the clerk informed me whether you certify one copy
from file concerned or complete file charges will be Rs.300/-.....so I went for full
bunch of papers ...... I have got around 30 plans and 50 papers certified for
Rs.300/- only.........
So pls help me out as I am about to Draft 1st appeal.........and what further actons
can be taken....thank you

Some departments (specially those which have large number of public dealings) have already prescribed charges for giving those documents. These are the normal charges which a citizen has to pay in order to get a copy or certified copy of those specified documents.
As you already know, the charges under RTI hve to be as per the RTI Rules - generally Rs. 2.00 per A4 size photocopy, etc etc etc.
4. The date on which you received the PIO's reply
5. The last date by when the first appeal was to be filed. This is 30 days from the date you received the PIO's order or 30 days from the date on which you were supposed to receive it.
1. Charges can be a ground of appeal. You can say that the PIO should charge as per RTI Rules and the prescribed charges.
2. If the PIO is offering you inspection, then it cannot be a ground for first appeal

with regards to point 2 of urs....actually Karira , PIO is telling to inspect that big potla and get the information required by myself, he wants me check each and every page and then he will xerox the papers whatever I have sorted from that bunch of files and plansSponsorer

At first I suggest you to stop visiting the office of the PIO unless it is very necessary to do so. Let them furnish all the replies in writing so that you have the valid proofs to appeal against them.Also pls stop depending on the dispatch clerks as their half knowledge will only misguide you. Always insists for all the answer in the writing.
Draft another application asking PIO about the charges of copies and certified copy of the orders about the same. Also ask for the procedure to obtain them.
No PIO will ever ask you come and inspect the potla in writing. They have to provide the information at your given address.

Dinesh in reply from PIO itself he has written charges of certification, it is like this ...
Charges for inspection of files
1. for 1st hour - no charges
2. after 1 hour for every 15 minutes or part therof - Rs. 5/-
Payment for certification of files
1. for IOD/CC/Approval letter - Rs.25/- per page
2. for approved plan - Rs.60/- per plan
U mean to draft separate RTI appliction askin charges, right........btw is there mentioned newhere is RTI act about how much to charge for certification of files...pls let me know

Had filed 1st appeal...some point I have written...
"I say that the certification charges are exorbitant. In support of my appeal I
furnish the copy of Receipt no x issued by the Fire Brigade Department
of M.C.G.M as per exhibit “4” and the copy of order by the PIO of Fire Brigade
Department as per exhibit “3”.
The Exhibit “3” order is for the same premises called x for
which I have requested information under application dated x to the
PIO of Building Proposals (City II).
Further more Rs.300/- was levied as certification charges by Fire Brigade
Department , which includes certification of thirty five A4 size pages and Forty
One approved plans"
