    Who is the cio for sixth pay commission secretariat?


    Dear All,

    Many pre-2006 pensioners are suffering from "incorrect" and "misinterpreted" implementation of the vital Govt. accepted/ Gazette notified recommendation of Para 5.1.47 of the Sixth Pay Commission's Report. Several OMs/ their Annexures-Tables have successively destroyed its coirrect meaning. Pre-2006 Pension which has to be revised based on the MINIMUM OF THE REVISED PAY IN THE RESPECTIVE REVISED PAY SCALES WITHIN PAY BANDS CORRESPONDING TO THE PRE-REVISED PAY SCALES FROM WHICH THE PENSIONER HAD RETIRED (all according to the CCS (revised Pay) Rules 2008/ Ministry of Finance's OM dtd 29th Aug 2008/its FITMENT TABLES etc, has been erroneously fixed at the MINIMUM OF THE PAY BAND for the concerned pensioners. This has put pre-2006 pensioners upto losses of 13% (in Scale S29 now) pm. Future Family Pensioners will also suffer. Recurruing losses due to decreased DR every six moinths will compound the loss further. Base Pension amount for next PC Revision will get eroded. Our querying thru RTI to arrive at the SOURCE OF ERROR is carefully by-passsed by the Govt. authorities like Deptt of Pensions and more precisely Deptt. of Expenditure. Lower end officials answer the questions and avoid carefully the sensitive aspects. We have reason to believe that some shying/ shielding is going on!. The OROP Report by the Committee of Secretaries now very apparently and carefully hint that the "Reduced Pensions" for S30 scale of pre-2006 pesioners was due to revising their pension on the basis of the MINIMUM OF THE PAY BAND and this has resulted in a "substantial difference" with respect to what pension they would have got had their pension been revised based on the MINIMUM as per the FITMENT TABLE! Same reasoning would apply to all other pre-2006 pensioners. Now S30 pre-2006 pensioners have got their correct pensions after Govt. revised and issued necessary orders.

    MY QUESTION IS - HOW TO SEEK CLARIFICATION FROM THE SIXTH CPC ITSELF AS TO WHAT THEY RECOMMENDED IN THEIR PARA 5.1.47 - DID THEY MAKE ANY AMBIGUOUS WORDING IN THE TEXT? WHEN MANY PRE-2006 PENSIONERS UNDERSTOOD THE RECO CORRECTLY, WHY THE GOVT, TRIES TO MAKE IT LOOK ERRONEOUS? TO SHIELD THE WRONG IMPLEMENTATION- WRONG INTERPRETATIONS? BY WHOM?.

    HAS THE SIXTH CPC ANY OFFICE- SECRETARIAT- AUTHORITY-CPIO- WHOM WE CAN ADDRESS THE RTI? OR IS IT THE CAB SECY HIMSELF?- IN WHICH CASE WE MAY NOT ARRIVE AT THE TRUTHFUL INFORMATION!

    Thanks Chandra- That is the problem!
    Govt. is conveniently taking shelter under this nebulous situation and has very "carefully" passed on the "blame/criticism" to the non-existing originator!

    Tried. No clue as to who is the CPIO / Dept of Govt. whom we can address- that too as the matter pertains pensioners. The DOPPW is ineffective as it is "bossed" over by DOE without whose concurrence/ approvals. nothing happens!

    Hi to all,
    the great site for assistance and social work.

    I have a problem in my Pay fixation procedure which is incorrect as i feel and approved by CDA.
    As per Rule 8 of CCS(RP) rules 2008, Pay for govt. employees appointed through direct recruitment after 01.01.06 is to be fixed: whether meaning of "PAY IN REVISED PAY STRUCTURE" is either "PAY in PAY BAND " or " BASIC PAY( which includes Pay in Pay Band + Grade Pay" . can anybody assist me to get the authentic information to get my dues.

    I thank Mr.Natarajan for his informative post. In fact, due to wrong interpretation between minimum of pay scale and minimum of the pay band, quite a few older pay scales get the same fixation of pension for pre 2006 retirees. I see the same disparity in pensions in all revised pay bands, as far as these pre 2006 retirees. I did not know that that this has been resolved for S-30 band. Could Mr Natarajan give details of the Govt. letters issued in this regard. This will help all of us in the community. Thanks again.

    The Revised Pension OM for S30 is issued by the Deptt of Pensions and Pensioners' Welfare on 20 th August 2009 vide their no 38/37/08-P&PW(A).
    It is available in the Pensioners' Portal website itself or that of the Ministry of Personnel. PG & Pensions.
    After implementation, pre-2006 S30 pensioners have got their revised pensions & arrears etc already!

    Dear Shri Santroingo
    There will be no problem for Pay Fixations as per CCS (RP) Rules 2008 after 1.1.2006. Pay in Revised Pay structure will always include Basic Pay (in the Revised Pay Scale)and Grade pay (corresponding to the former) and this will be termed as Emoluments for all purposes. MOF's OM F No 1/1/2008-(IC)Dated 30th Aug 2008 with FITMENT TABLES provided under CCS(RP)Rules 2008 can be consulted. Pl see the Ministry of Finances website/ or National Portal of India (indgov.nic.in-website's Sixth CPC Page) for
    circulars/ for all info.

    While trying to establish the TRUTH in regard to the query with which I started the thread, as a real RTI CRUSADER, an interesting SOUL-SEARCHING query has been posed to the Central Pension Accounting Authority recently and the same is pasted here:

    Dear Sir

    I seek the following information under the provisions of the RTI ACT 2005, Sections/Para 6 (1), (2) (3) & 7. In case the subject/ matter are not dealt at your desk/ office, the same may kindly be referred to the right source within the stipulated period. Time-frame may kindly be adhered to, as it concerns the life/ liberty of the very aged pensioners/ family pensioners.

    Your kind attention is invited to the Controller of Accounts (COA), CPAO, Lr DO No: CPAO/Tech/6thCPC/Misc/1265 Dt September 26,2008 addressed to ALL NODAL OFFICERS (Authorised Banks), with Annexures I & II.

    The letter appeared in two versions in the CPAO’s website-of which old version (OV) directed all nodal officers of authorized banks to FIX the pension of pre-2006 pensioners on the basis of the MINIUMUM OF THE PAY BAND whereas the new version (NV) (now available on the website of CPAO) directs all the nodal officers of the authorized banks to FIX the pension of the pre-2006 pensioners on the basis of the MINIMUM OF THE PAY IN THE PAY BAND.

    Obviously, the FORMER (OV) version of the letter is ERRONEOUS or NON-OPERATABLE and hence the LATTER (NV) has replaced the same without change of DESPATCH NO and DATE of issue.(Though aberrations are possible in letters issued in haste, such an action IF TRUE in this case, has affected the PENSION FIXATION OF THE PRE-2006 PENSIONERS in a great manner bringing in HUGE DISPARITIES in the pensions that have been allowed to be released by BANKS and the pensions that should have been released by them, in the case of all so affected ).

    I request concerned authorities to help to furnish fully transparent/and in a citizen-inter-active governance spirit as per RTI constitution, ANSWERS to the following queries and provide copies of relevant material containing the information etc.

    1.What is the LEAST BASIC PENSION in RUPEES PER MONTH that is NOTIONALLY or OTHERWISE applicable/ permissible (for PENSION ACCOUNTING) to an officer of the Grade of JOINT SECRETARY TO THE GOVTOF INDIA retiring after 01 January 2006 ( or died in office on 01 Jan 2006) with full qualifying service of 33 years? Relevant copies if any of records/ Rules/other information may be provided.

    2.Copies of both the versions of the COA, CPAO’s letters (ref: cited in Para 2 above) dt 26th Sept 2008 (no 1265) together with Annexure II only, in signed/ issued versions to the NODAL OFFICERS of BANKS together with the respective lists of BANKS to whom the two versions have been dispatched with dates may also be furnished.

    3. What steps have been taken (through DOE/MOF or otherwise) to appraise the BANKS to refix the pre-2006 pensioners’ pensions in view of the change of basis from MINIMUM OF THE PAY BAND to MINIMUM OF THE PAY IN THE PAY BAND? Please provide copies of related documents/ papers.

    4. What steps have been taken (through DOE/MOF or otherwise) to inform the Department of Pensions & Pensioners’ Welfare /Ministry of Personnel, PG& Pensions, GOI, for effecting necessary/ suitable changes to the OMs No 38/37/08-P&PW(A)pt1 dt 3rd and 14th Oct.2008, particularly in regard to the ANNEXURES I and II which are being consulted by the Banks in fixing pre-2006 pensioners’ pensions.? Please provide copies of related documents/ papers.

    5. What are the GUIDING DOCUMENTS/ PAPERS/ FILE NOTINGS/ OMs/ORDERS/ GAZETTE NOTIFICATIONS/DIRECTIVES etc that are available with your office and or related office (s) with whom you have to inter-act like Deptt of Expenditure/ Deptt. of Pensions & Pensioners’ Welfare etc that categorically EQUATES to confirm that “MINIMUM OF THE PAY BAND” is one and the same as “MINIMUM OF THE PAY IN THE PAY BAND”? Please furnish copies of the same.

    6..IF YOU DO NOT HAVE ANY OF THE ABOVE stated in Query 5 above, pl confirm the same.
