Housing Society Formation in Mumbai

Dear Sir,

We bought a flat in Mumbai Andheri West last year in 2008 where in we were told by the builder that the society will be formed shortly.Its been 1&1/2 years now but the builder is not keen in forming the society.We had a couple of meetings with the builder and he states that there is a few o/s with some flat owners.After initial findings we learnt that his building contractor a close aid of the builder sold few flats to his friends, some associates and the dues are from their end only.Due to these dues the Builder is reluctant to form the society and is unnecessarily delaying the same.Please guide as how we should go abt formaing our own society without his help.Also guide on the few queries too.

1)Builder has installed 4 Mobile towers on our teracces which generates good income to him........is an NOC required from Flat owners even if society is not formed.

2)Builder is charging exorbitant transfer rate of INR 500/-PSQFT on sale of flats and if not paid then he wont issue NOC certificate to transfer the flat.

3)The builder has not paid the prop tax of the building for last 3 years.

4)Builder has already collected 4,000 as soc formation charges from each one of us.

We in short term see no sign of builder forming us the society and request for an help from RTI.
