Dear Friends,
Warm greetings,
Thank you for the replies / advice.
Showroom " A " has unauthorised construction of three floors.
The showroom has been built on two properties (which has different owners and ownership documents) combined together with two roads bordering it on the north and the south
On the north side the property has a door number 6 on that road and on the south it has a door no 56 on that road.
We had applied to the high court complaining about the unauthorised construction at door no 56 .The High court had requested the CMDA to look into the same.
The CMDA took a stand that a demolition notice had been issued in 2002 but due to blanket court orders the same could not be put in effect.
We had requested a copy of the demolition notice under the RTI act .they have sent us the demolition notice for property no 6 on the north side .Repeated clarifications that this is a wrong document furnished is faling on deaf ears .

1. Has CMDA furnished the information [partly correct or incorrect/ misleading] within the Mandatory time frame under the provisions of the RTI ACT 2005?
2.The clarifications you have mentioned; have they been asked formally...? ie have you asked these clarifications by regd post or by a letter duly received and acknowledged by the Dak section of CMDA? If not kindly do so...
3. If CMDA has not responded despite the formal letter of clarification addressed to them, then you may go in for filing first appeal, in case the mandatory 30 days time to reply has been exceeded. Have you filed First Appeal? To know more about how to proceed and other relevant sections of the act then PLEASE CLICK ON THIS LINK.
CMDA will be hesitant to reply or provide the information which may put them in a spot, but, if you are persistant and follow the case in right earnest, they will be obliged to part with the correct information. Under the RTI ACT 2005, the PA either provies the information asked for or denies it quoting reasons and relevant sections of the ACT.
