This is a discussion on can one go to CIC b4 first appeal within the Ask for RTI Query forums, part of the RTI Community Support category; can i go to CIC directly without going through first appeal?? PIO is refusing information on filmsy grounds like IPO is not acceptable etc...

nukebomb, The Sec 18 is for Complaints and Sec 19 for Appeal procedures. Just see which Section is applicable to the rejections by the PIO and proceed accordingly. CIC always prefers that you complete the First Appeal under Sec 19(1) before filing Second Appeal under Sec 19(3) or complaint under Sec 18. |

| As suggested by othres it is always advisible to exhaust the internal mechanism within the same pubic Authority. if the CPIO is denying the informations on filimsy grounds make first appeal to the AA citing the reasons for making the first appeal. in some cases, i have seen appeals directly approaching the CIC/SIC is returned with the suggestion to approach first Appellate Authority and then if agreived even after the decision of AA, you can approah the CIC/SIC by way of second appeal. |
