    negligence to carry out repairs by Co-operative housing society

    “Under bye-law no. 156 it shall be the responsibility of the committee to maintain the property of the society in good condition at all given times. Under model bye law No. 157, the secretary of the society on receipt of any complaint (vide our references letters) or on his own motion, shall inspect the property of the society and make the report of his finding and recommendation to the committee member with the copy to the complainant stating the needs of repairs”.
    If the society has neglected to carry out the necessary repairs the complainant can compel the society to carry out its obligations, and can also further file a dispute in the co-operative court against the society and its governing body under section 91 of the Maharashtra Co-operative Societies Act, 1960.

    It is evidently comprehensible that in spite of numerous requests and written communication the Secretary on personal grounds is showing laxity to our requests to carry out the necessary repairs inspite of numerous written communication.
