Need Help: CPIO reply recd after sending 1st Appeal. Should I again file 1st Appeal

I had applied RTI application to MEA, Akbar Bhawan on 17/8/2009 which then transferred my application to MEA, CPV Division, Patiala House on 21/8/2009. On 26/8/2009 MEA, CPV Division, Patiala House again transferred my application to Indian Embassy Lebanon. After not recieving any reply I filed my 1st Appeal in CPV Division, Patiala House on 23/10/2009. Then on 28/10/2009 I recd an envelope from CPV Division giving information pertaining to my RTI application dated 26/8/2009. I am also not satisfied from this reply. Also 35 days have expired from the date of 1st Appeal to CPV Divison. Please suggest should I file my 2nd Appeal to CIC ?

Your post appears to have a typo. You received unsatisfactory info for your RTI dt. 17/8 and not 26/8. Am I right?

Apart from this, it would be advisable -- both legally and practically-- to file a fresh first appeal to the Appellate Authority related to PIO who supplied you unsatisfactory info.

You still have right to file second appeal after disposal/non disposal of your fresh first appeal.

My RTI application was 17/8/2009 which then transferred twice. So my RTI application date should be 17/8/2009. Also the envelope I recd from CPV division on 28/10/2009 doesnt has any covering letter addressed to me. This letter was sent by Indian Embassy Lebanon addressed to CPV Division, Patiala House and not addressed to me and only a photocopy has been sent to me.

dear sir .
it is a common trick of CPIO to send response only after recieving first appeal . so that out of confusion applicant tend to not to file first appeal .
NOW I always post a reminder letter to CPIO in case i do not recieve reply within 30 days .
this way i never need to post first appeal twice.
Even before posting second appeal , plz try to send one reminder to FAA about your un satisfaction and let him answer to your reminder. if he fails to reply post second appeal enclosing copy of reminder also.
