I have bought apt recently and builder has charged service tax. Now after getting inforamtion from Service tax PRO, he is saying we are eligible to get back service tax as per new law. Our builder is not ready to provide Service tax paid receit( challan no). Can you please help me in directing how to apply for RTI information to get Service tax challan no so me and my fellow apartment resident can apply for Service tax refund. 1. Please direct me to proces for RTI . 2. Where i need to submit application for Service tax ( electronicity area, bangalore) |

There is no need for a RTI on this.Just find out in which area is the office of your builder and in whose jurisdiction is he registered under Service Tax. It must be the nearest office for Service tax. Visit that office and get all the details form the PRO. If you find that the PRO is not helpful, at the end of the meeting ask him to provide you the Name/Address/Designation of the PIO under RTI Act 2005 to whom you can send a application under RTI Act. |

Hi All, I want to find out how do I file RTI with Govt to check whether my builder has remitted the Service Tax to th govt which he collected from us.The lawyers are saying that only Sobha can claim for refund with the govt if they have remitted te Tax to them. If they have not remitted the tax to the govt, then Sobha should directly pay our Service Tax back to us. My builder Sobha Developers is not responding to our query for Service Tax refund. So before I take legal action against them, I want to know whether they have paid the Service Tax to govt or not. How do I file RTI for it ? |

I recently purchased a flat in Bangalore and the builder has charged service tax on the same. After enquiring he has suggested us to get the refund from the department. as a customer can I directly approach service Tax department and claim refund? Can some one clarify on this? |

I purchased a flat in chennai..The builder is asking for service tax...but according to the circular service tax is exempted for residential complex..we ask the builder about this....He accept that service tax is exempted but he said that they are collecting service tax because for there audit they are asking about the service tax...so we have to pay...He said he will give the receipt for the service tax after paying to the government...Please help me what to do...Please reply... Thank you... |

| Dear All, I purchased an apartment in Tamilnadu during August 2009, made a sale deed and registered the UDS immediately in my name, the stage at which the apartment was almost 95% completed. At that time, I was not aware of the circular issued by the Central Board of Excise and Customs, Department of Revenue, Ministry of Finance, Government of India circular No. 108/02/2009 F.No. 137/12/2006-CX.4 dated 29th January 2009 on "non-applicability of Service Tax" for apartment buyers, the apartment buyers are no longer needed to pay service tax. Now after knowing this (having the apartment construction fully completed in Jan 2010), immediately I paid the entire amount for the apartment except service tax amount and when approached the builder, they stated that I need to pay the service tax or else the apartment will not be handed over to me. When I discussed with as much of people I could, no body was able to clarify the issue. Hence, I request some expert member to guide us. Because, a substantial amount will be saved by our members whoever has purchased an apartment. Best Regards, Roby |
