    provision for return of cheque by cpio

    Sir
    I had soughtfor a copy of the judgement of SCI by remitting an amount of Rs.200/- towards cost application and material cost as per the prescribed
    norms in the RTI Act but the PIO while advising me remit amount as per the SC rules 1996 and returned back my cheque for which there is no
    provision in the Central Act and as such I had sought for a specific clarification from the nodal ministry. Filed first appeal before the AA and
    and issued notice for my presence for oral submission if any on 14th Nov 09 and on its I sought for an adjournment AA upheld the decision of CPIO
    stating that I was absent but silent about my adjournment letter I had also sought for a speific clarification from the nodal ministry whether CPIO can return the cheque presented by an RTI applicant. It has been clarified by the Department of Personnel and Training that there is no provision in the act for returning the cheque to an applicant. The AA upheld the decision of CPIO without giving any opportunity or sent any
    further reference prior to passing orders and advised to file 2nd appeal
    before the cic within 90 days I am yet to prefer second appeal

    Thank you very much for spontaneous and prompt response I am sorry it was a typographical error the mode of payment effected be me was through a bank demand draft but not cheque as earlier stated by and the said demand draft was returned by the CPIO of Supreme Court of India for which there is no provision for returning fee once paid by an RTI applicant. The Department of Personnel and Public Grievances Department of Training a nodal ministry have clarified that there is no provision in the Act/Rules for returning the fee and against the prescribed norms I am yet to file second appeal before CIC New Delhi by contesting the above position specifically
    It is requested to tender considered views/advise
