As reported by PTI in hindu.com on 15 May 2008: The Hindu News Update Service CIC directs CBSE to disclose information on unaided school New Delhi (PTI): The Central Information Commission has asked Central Board of Secondary Education (CBSE) to disclose information relating to an unaided school affiliated to it. However, it held that unaided schools do not fall under the purview of the RTI Act but since they were affiliated to the public body, information relating to them -- in possession of the CBSE -- could be disclosed. "While the Commission treats the school as outside the purview of the RTI Act as it is an unaided one attracting no provisions of the Act, however, since it is affiliated to the CBSE, to that extent, information may be disclosed to appellant," Information Commissioner O P Kejariwal said. The transparency panel said that the RTI applicant was authorised to go through the material in possession of the CBSE relating to the school. Sudhir Kumar Jhalani, a Jaipur resident, had filed an RTI application in May, last year with the CBSE seeking information relating to physical assets of an unaided school. Being unsatisfied with the response of the CBSE, the applicant moved the CIC in August seeking a direction to it to disclose details sought by him. Following a hearing in the matter, the Commission directed the CBSE to reveal information on school regarding its suitability for getting affiliation from it. |
