    Arrow special purpose vehicles, centre-state partnerships, and oddities.

    1. Do SPVs (special purpose vehicles) formed for execution of specific projects by Government bodies, come under RTI?

    2. If an organization is an equal partnership between Central and a State Government, which RTI laws would be followed, Central or State?

    3. In case of defunct PAs, where there is no clear successor, who should be approached for information?

    4. In case a private body gets nationalized, do its records prior to nationalization come under RTI?

    5. In case a Public Undertaking gets privatised, will RTI still be applicable to it? At least to records upto that point?

    These points were raised by (I think) one of our new members about a month ago in a group meeting. Since he has not raised them on the forum yet, I thought I should do so.

    1. SPV: Never came across any SPV being involved in RTI, so really do not know.
    But this is a important issue because many public services are slowly getting privatised and this problem will surface sooner or later.

    2. No clear answer, but use the one convenient to you as an applicant.

    3. Go strictly by "who is the present custodian of records " ? That is where the RTI will have to be filed.

    4. & 5 also needs to be discussed threadbare.

    Personally, I think in both 4 and 5, the answer should be NO.
    In case of private body getting nationalised, one will have to see the details of the order for nationalisation. What exactly does it say about the records, etc. ?

    In case of 5, I think there was some issue with BALCO vis a vis RTI - pre and post privatisation.
