Since 1997, woman sitting on dharna, awaiting justice As reported in Express News Service Lucknow, June 4 In April, District Magistrate was fined for not providing information under RTI, but still, no reply materialised First her family, then the law-enforcement agencies and now even the Right to Information Act seems to have failed 42-year-old Umalakhan Pal. Expelled from her father's house by her brother, Pal got some respite from the High Court, which upheld her right to property. But the court order was not implemented and even though Pal filed an RTI application in September 2006 to know why, she is yet to receive a reply. This — even after the District Magistrate has been penalised by the Information Commissioner two months ago. Pal has been on a dharna before the Vidhan Sabha for the last ten years, awaiting the implementation of the court order. She had filed an application with the District Magistrate, Lucknow, under the Right to Information Act in September 2006, seeking the information about the steps the DM and the SSP had taken to comply with the HC order. Taking cognizance of the fact that the local administration has not furnished the information to her, Information Commissioner VK Saxena imposed fine on the District Magistrate Chandra Bhanu. But even though Saxena passed the order on April 30, no information has been provided to Pal till date. As per the Information Commissioner's order, the DM will have to pay a fine of Rs 250 daily till he provides the information and the maximum amount of fine could go up to Rs 25000. Uma began her dharna on August 30, 1997, when her brother Bhanu Tiwari allegedly expelled her and her husband Supriyelakhan Pal from her father's house after the latter's death. She had alleged that Bhanu sought to take sole possession of their paternal property located at 59, Khursheedbagh in Lucknow. "I moved the High Court in 2005 that directed the administration to ensure my share in the property. But the administration has not taken any step to carry out the court's orders," Uma said. Regarding her RTI application, Supriyelakhan said: "Police informed us that an action has been taken on our submission, but this is a lie. We have not got possession on property yet and are forced to live in open as we do not have any other shelter." Taking note of Saxena's order, Uma said: "Over one month has passed after the IC's order, but the DM has not provided any information yet. We are again going to approach the IC." Responding to the charges, DM Chandra Bhanu said: "The information was duly sent to the applicant, but our case was not presented properly during the hearings before the RTI court. 5.6.2008 The Revenue department of Gujarat Government refused to give FILE NOTINGS of a public interest matter. I asked what action is taken by the revenue department on Hon. Gujarat High Court orders / Directives dated 18.4.2001 and dated 2.8.2002 passed in SCA # 10621 of 2000 about removing the encroachments from the WATER BODIES of the STATE particularly fron Vadodara Ponds / Lakes and NATURAL STORM WATER DRAINAGES which is of public interest. The Revenue department Dy. Secretary wrote that the FILE NOTINGS can't be given as per GAD RTI Cell circular dated 14.11.2005. Even after so many orders of the CIC / States CICs that the FILE NOTINGS are the part of the FILE even than the Best administered State Gujarat Government does't believe in transparency to give FILLE NOTINGS to an RTI Act 2005 applicant. The State CIC of Gugarat already passed orders to give FILE NOTINGS but all in Vain for GUJARAT State bureaucrats, Dr.R.K.D.Goel Vadodara. Ph: 0265-2647677. |

Dr. Goel, Did you try to show the PIO/AA some copies of CIC/SIC orders allowing disclosure of file notings ? If that did not have any effect, then you can directly complain under Sec 18 to the Gujarat SIC about the "file notings" matter. |
