    Sl no/Application Date/Information provided /Nature of information sought
    1 21.06.09 15.07.09 Regarding W/S connection
    2 20.07.09 12.08.09 More queries linking to inf provided at sl-1 above+additional queries
    3 22.08.09 18.09.09 More queries linking to inf provided at sl-1 &2 above+additional
    4 19.09.09 02.10.09 More queries linking to above+ additional.
    Being aggrieved, the applicant preferred a first appeal.
    Appeal date - 07.10.09
    Nature of information sought. –Linking to PIOs reply at Sl 1,2,3&4

    Is the 1st Appellate authority bound to pass orders for the entire subject of the appeal/limit his order to the portion of subject matter (PIOs reply) falling within the time limit for 1st appeal? Can the appellant put further queries in the appeal linking to the replies of PIO ? Pl explain the role of the Ist Appellate Authority with ref to above status.

    Please do not mix up.

    You filed a First Appeal on 7 October 2009.

    By that time the the S. Nos. 1 and 2 were time barred.

    No further information can be sought during first appeal. You are making a first appeal against the order of the PIO. Just stick to that.

    Thank U Karira sir. Pl explain the counterside ie the role of FAA to such a case.
    Can he reject the appeal as it mixed up of subject of 4 applications?
    Can he reply to the latest one ie application sl 4 on the principle one-for-one?
    Should he reply for Sl-3&4 as both fall within the time limit of 1st appeal?

    Legally he cannot do that.

    But the FAA is much smarter than you and me put together !

    You have just given him an "excuse" on a platter, to reject everything.

    Since the damage is already done, just play it by the ear during the first appeal and go with the flow.

    If you are not going to appear personally for first appeal, just wait for the order and then decide what to do.

    Dear members,
    If you were the FAA for this particulr appeal, than what would have been your action within the limit of the RTI Act? Soliciting a reply with ref to the sections of the act.
