    Exclamation Is RTI Applicable for Public companies?

    Dear Friends,

    I would like to know whether Public Sector (Govt) companies come
    under RTI screening?? Are they liable to answer the queires about
    the fundings done to JV's / R&D's and the reason for continuting the same>>

    Kindly provide the details.

    1. Public Sector (Govt) companies come under RTI.

    2. RTI can be used for obtaining information which is available with PA in any material form.

    Default RTI applicable for JV firm - 55% Private & 45% public

    Hi Friends,

    I just gone thru' the CIC document of LICHFL which had a lot of interpretations for the word 'SUBSTANTIALLY FUNDED' mentioned in the RTI. As I'm not clear on this part, would like to post the below query.

    Whether a private company which has 55% stake by an Foreign MNC and 45% stake by Indian Public sector company which has a JV for the last 3 years can be requeted for information under RTI??

    The word "substantial" can mean different things to different people as well as at different times. It cannot be strcitly based on majority/minority holding.

    Apart from substantial, you have to also see who "controls' the entity ?

    Can you share the name of the Company ?

    Recent decision of CIC in SBICards - NSDL - has stated that they are not
    PA even though they have more than 50 % ( or substantial funding ) of govt funds collectively

    Most of psu where CAG conducts audit is PA.
