My name is RAMESH and my mobile no is 9967443905. I was using this card for more then two years I would like to mention that it’s a life time validity card. From last 20 days I didn’t use this card. Because I was out of station. Whether I used my card or not it’s my choice because its life time validity card. so when after 20 days I used this card it says sim card registration failed when I contacted airtel relation ship center they told me that your card is install and given to some one else. When I contacted nodal officer he is telling due to address verification we have disconnected your sim card. I don’t understand where they where for two years when I was using this card. The main thing is that my card contains a balance amount of 6730.80 so when I asked what about balance they told me it’s gone now. Airtel had cheated me and they had taken such a big amount from me because whenever the card disconnect it’s not given to some else up to 6o days. Ok if they had disconnected after that they should give sometime but they had immediately given to someone else just because they know that this card has balance 6730. If they want they can check the data base and help me but they don’t want to do this. I think sunil mittal is becoming rich day by day by cheating like this only. | The choice of using the connection is left to subscriber if it is a life time connection. Though the airtel has authority to disconnect your SIM if you do not specify proper proof of address, the connect should be restored with in 24 or 48 hours when proper proof of address is produced. I can understand that u are cheated . you can lodge a RTI application with CPIO TRAI

Dear Ramesh, Please take the help of RTI as it is good ammount. The Public Information Officer Telecom Regulatory Authority of India(TRAI) Door Sanchar Bhawan, Old Minto Road, next to Zakir Hussain College, New Delhi 110002 In my case an ammount of Rs.300 was automatically deducted from my main balance, When I wrote to Airtel that, I will put the matter before the TRAI, in no time my balance came back to me.

We Help & The Great, are you two suggesting a complaint to TRAI or RTI to TRAI ? The case is basically a deficiency in service on the part of the service provider Airtel.

Ramesh, as per "consumer protection and redressal of grievances regulations,2007" ,each Telecom company is obliged to appoint a Nodal Officer and an Appellate Authority for each circle/state in india.For Mumbai,its as follows:- Tel: 9987234865 emails: nodalofficer.mumbai@airtel.in appellate.mumbai@airtel.in Address :- 7th Floor,Bldg No 7 Interface, Mindspace Link Road , Malad(W) Mumbai-400064 Suggest speak to Nodal Officer (Ms Abha Gupta) first and if no action is taken,please contact Appellate Authority. Both have same Tel No and address . You can follow that up with written complaint , registered ,with AD, giving truthfully total details,and please also mention names and addresses of Airtel persons/retailers involved in this whole case . I had contacted the nodal officer via email but he says your number is permanent deleted from prepaid system and we can’t help and whenever I try his number it’s always busy. I’m not getting one thing how fast they had done all this things. Ramesh, 1.Please send another e-mail to airtel ,referring to their email reply,and this time send to appellate authority with all details asking for reasons and rules under which connection was disconnected and whereabouts of your balance money of Rs 6730/-,and with a copy to : trai@trai.gov.in ,trai@del2.vsnl.net.in 2.Also ,without furthur awaiting, send registered AD mails to Appellate Authority at above given address of Airtel , and also copy of that letter to:- The Telecom Authority of India Mahanagar Doorsanchar Bhawan (Next to Zakir Hussain College) Jawaharlal Nehru Marg (Old Minto Road) New Delhi-110002 If you want to visit TRAI site : http://www.trai.gov.in Last edited by opsharma; 07-01-2008 at 10:19 PM. |

Dear Ramesh, This is a clear case of deficiency in service and is covered under the consumer protection law. You can definitely file a complaint with the Distt Consumer Protection Forum u/s 12 of the said law. Prior to that it is mandatory to give a notice of the same to the service provider. I feel that along with filing a RTI application with TRAI and the Dept of Telecom you can also claim your money thru the consumer forum. TRAI has restricted area of jurisdiction it can not entertain individual complaints the complaint has to come from a group or society. Writing to Dept of Telecom at Sanchar Bhawan, New Delhi may be of some help to you. Wishing all the best in getting your money back ajay |

I think, TRAI entertains only generic type of complaints. DOT will be helpful. Best way is to serve a notice under Consumer Protection Act on the MD of Airtel claiming amount of dues plus compensation for mental agony, loss of business, interest, cost, deprivation of social and family contacts etc. Huge amount can be claimed. Filing complaint in consumer forum of your district is very easy. U may visit websites of consumer protection like corecentre.org, fcamin.nic.in, advantageconsumer.com, ncdrc.nic.in and file complaint yourself, if U do not want advocate,s help. There is Consumer Protection Council also in each district which is established by state govts for helping small consumers. U can use toll fee helpline of Ministry of Consumer Affairs-see doordarshan on tv [jago grahak jago ad]. U will definitely get money and huge compensation. Keep on trying.

In my opinion file a RTI application to the,CPIO, TRAI. I think application or mail to directly to the Appellate Authority may not count.Go to rtiindia.info Click on down load, then type Sample Application Form in the search text. you will get the Form.

In my opinion the best solution is by going to a consumer court under the Consumer Protection Act. Simultaneousely you can make a complaint to the DOT and TRAI who in turn will forward your request to the Director Legal & Regulatory Affairs of Airtel. After a resonable time again write to them asking about the status of your complaint under the RTI Act this will put a lot more of pressure on these departments and in turn may help in getting you thru with your problem. |

I had sent a complaint to dot they told me that the entire process of complaint will take up to 2 months. I had send lots of mail to airtel appellate authority but it has not responded me nor he had reply to me. I had also send mail to trai from their also I didn’t get any reply. Ramesh, the best thing would be to go to a consumer court. The reply that you receive from DOT will be useful documentary evidence in the consumer court to strengthen your case. You can also write to DoT and TRAI seeking the status of your complaint under the RTI Act. |

As suggested by Mr Bahl you should use consumer protection act for the redressal of you grievance. RTI may not be of direct help in this case. Airtel being a private company, is not bound by RTI. But the other authorities such as TRAI and DoT are public authorities bound by RTI. Hence besides filing a case under consumer protection act you may also file complaints with TRAI and DoT. If they are inactive, you can activate them using RTI. |

RTI arms U with information and papers so that U can effectively pursue your case in consumer court or other courts/tribunals. We could successfully plead cases in consumer forum after obtaining papers through rti, which were earlier denied for months together. Thus RTI and Consumer Movements are supportive to each other. However RTI generates pressure on PA for wrong doings being exposed and hence they solve your problem at their level to your satisfaction!

Hi friends, after two months of my effort I got new airtel sim card with my entire balance of 7000 I would like to share that after I get no reply from nodal officer and appellate authority I forward the complain to trai but there also I didn’t get any response then I wrote to dot and also to all the officer of dot and continuously I prompted them what is happening of my complaint at last I got sim card by courier with my entire balance. The task was not simply for me because the nodal officer replied me that your data is permanent deleted from prepaid system. I had seen that people are not getting any response from airtel gallery, and a normal person can go to gallery and that is last option for him. How many people know about the nodal officer and if somebody know also the nodal officer never pick the phone nor he give proper response to people so where the normal person will go. The gallery representative also doesn’t tell if your query is not sold you can contact nodal officer so how the people will know about it. So its my request to all if we can do something for them because some one has to take first step if we can tell service provider if the person query is not sold he should contact this higher authority and all gallery should have that written on board so that person can look and forward their complaint to them. If they are also not solving their problem then they can contact us and we all will help them |
