Default Address of PIO Army Hq, New Delhi

    Kindly answer,
I served Indian Army for 22 years and took premature retirement in Nov 1996.
I have submitted all required documents in time , but my PPO ( Pension Payment Order ) was issued after delay / protracted correspondence after nearly TWO years.
My case was admitted for interest & compensation in 1999 in HC jabalpur and was transferred to Bilaspur HC in 2005. It had to be withdrawn in Jul 2009 on the grounds "no jurisdiction" with ' liberty to avail remedy available'.
Now I am in Bangalore and this need to be filed in Armed Forces Tribunal in Kochi.

My question is ' is there a remedy under RTI' - easier / quicker ?
    request advice.
    Regards
Lt Col ( Retd ) TVP Rao

RTI is limited to getting you "information".
It will not be of any help in getting compensation/interest.

You would have filed demand for compensation and interest. If you have not received reply from Army you may try:

    Col Rao,

Yes Provided the remedy you seek is "INFORMATION". The cryptic brief of your case contain far too many blanks. With such constrains we may not be able to offer any comment or advice. However, in case you need any information which is HELD by any of the Public Authorities that can help you to get the relief you need, members of this forum will be happy to be of assistance provided you are willing to open out.

Some of questions that can be asked from Army Authorities under RTI Act 2005 :

    • Date on which the PPO prepared
    • Date of dispatched of PPO
    • Reason for delay in dispatch of PPO
    • Department/officer responsible for the delay
    • Whether interest is payable in case the delay is caused by department.
    • Copy of relevant rules and order etc.

You can post draft of your application at this site so that the members can help you further.

    Dear Dinesh,

Central Government employees in general and Defence Forces in particular have a well laid down time schedule for everything connected with retirement and payment of pension. If that schedule is followed correctly, there is no reason for a retiree in not getting his pension on the subsequent pay day of his retirement. I can speak with authority that I retired on 31st May 1988. On first June I got my regular pay of May. I received my first pension on 30th June 1988.

In this case the officer having sought premature retirement, the normal time schedule for regular retirees may not be possible; but, had the officer submitted all the papers as per the requirement from date of his retirement order there could not have been any problem in getting his pension asper time schedule laid down or earlier (Normally the CDA(P), Allahabad need 10 months time to process the case. Normally there cannot be any delay in the instances you had adviced seeking information. That is why I wrote that unless we know the complete case, we may not be able to be of much help.
