Hi all,

I am being harrassed under 498A of IPC by my estranged wife and in-laws and their relatives. I am trying to get the copy of the complaint, i have the crime no. with me, but my advocate is not able to get the copy from police startion and police is also not giving us the copy. What should i do ?

Hi Nirmal,
You can surely file an RTI application addressed to the PIO-cum-DCP of your area, asking for a copy of the complaint copy for the complaint number that you have.
Also ask some more questions like, 'What investigations are done pertaining to the complaint?', 'What evidences do they have to prove the allegations laid therein?', What other actions have been taken by the police regarding the complaint?', etc.

Thanks for your reply. My advocate asked for copy of complaint which is registered at my wive's native place, the Sub inspector of the police station denied to issue copy saying the complaint has been endorsed by the court.

I live in a different city. Should i pay any fees for RTI application. From where can i know the application fees details.

Dear Mr Nirmal Narayan,
Make an application under RTI to PIO c/o SP for a copy of complaint. If it does not work appeal to IG. Don't have any fear or hesitation of Police.

i certianly don't agree with your above quote.

as in a case, an applicant filed a RTI application with the PIO, Passport Office, Ghaziabad. the PIO wan an ex-IPS. he sent the police walas to the applicant's place and those police walas tried to threat that applicant.

however the PIO was penalized by the CIC.

Well Mr Nirmal is already in the dock. So if he faces them boldly, they may act in a fare manner. If they find him submissive and afraid, they will loot him. I have been able to obtain complete records of investigations from IG office including file notings. I showed to PIO a cutting of newspaper where PIO has been fined.

I can give u my own example... Mine is a similar situation, that the case is in a different state than I am. And I can safely say that the police of that place is scared to face me today... Not because of any force or influence I have, but simply because I exhibited the power a common citizen possesses and the police don't!
My RTI's have created so much panic in them, that can be seen in the way they've replied me... Not only that, they were not filing any chargesheet for 6 months after the FIR was filed... But due to my RTI's they filed the CS in such a hurry, though it is just a single page CS, still there a million mistakes in it... And these mistakes themselves will get the case in my favor eventually... And all this without a single penny given as bribe to the police!

You can ask for copy of FIR from majestrate as within 24 hours it has to reach him.

Use political influence if required as police best listens to them.

To add to that... the link to join SIFF is this.

And don't count on political influence, esp. if you don't already have some... File an RTI to the SSP and the magistrate too, for providing you the copy of all the documents you need... Once the wife goes to the police, she and all her documents become public property. Ask for it under RTI.
