Flat Possession Letter delay for 3-4 yrs? WHy
I have purchased a flat in AmbaNagari Co. op. SOciety, Building No. 1, Dhanori Road, Vishrantwadi, Pune 411015 in year 2006. SHree Hari Builders had given us provision Possion letter on their letter head for furniture work. all the flats are occupied in thie building #1 and peoples are staying for 4-5 yrs or so and no one had got possession letter yet. Builder is saying that there is some case pending and at the time of allotment of flats, they told that it will be done surely in 1 yrs and it is almost 5 yrs or so and we are not getting satisfied replies from Builder or Society Committee yet. We are lost as what to do as the registerar office also dont give us satisfied replies so far to any on. We have all documents with us and the building is all functional for many years.
Secondly, As builder commited that unless we dont get possition letter, We are not suppose to pay any maintanance charges and builder will pay the maintanance untill then. Now the builder had handed over the society to committee and committee is repeatedly sending us legal notices for society maintanance and charging us huge fines. Society is telling that they will issue the Share certificate only when we pay them full society charges from the day we got the possition whereas we havent yet got possission letter. no one in building #1 had got it. We want to ask the society as which law are teh following and why when there is delay in possision letter to all building #1 owners?? secondly why the builder 'SHREE HARI' handled by M&T (Mittal & Tyagi) builder doing delay in possision certificate issue??? and when we will get that. We have never been shared any case details or reasons for this.
Please help us all in our society. We will apreciate this all over thegovernment for the RTI help.
